  • Page 16/THE WESTERN CAROLINIAN/March 27.1980 Collect your debts in claims court By Sandy Cavendish Contributing Writer A poll was taken on 530 WCU students last week on the small claims court. Out of these students, 246 did not realize the purpose of the court. The following article will present a brief explanation about the small claims court and the procedures used for bringing suit in the small claims court. The small claims court provides the average citizen with a speedy and inexpensive method for settling small claims in which the amount in controversy does not exceed $800. (This amount applies in North Carolina; however, it varies from state to state.) The costs are kept down in this court because the assistance of a lawyer is not necessary. Most cases involve a claim that money is owed to the person who sues. The procedures for bringing suit against the person whom you are suing, the defendant, are simple. The first step is to file a written "complaint" with the clerk of Superior Court at the courthouse in the county where the defendant lives. A small filing fee is paid at this time. The "complaint" would include the reason you are suing, the amount of money involved or a description of the articles you wish to recover. The clerk will help you set a court date which would be no later than 30 days from the time you file the complaint. Notice to the person you are suing to appear in court would be delivered by the sheriff or sent through the mail by the clerk. In order to be prepared for trial, it would be wise to visit the court as an observer. The clerk's office can tell you when and where the court is hearing cases. The court proceedings are simple and informal. You will first take an oath and then state your story simply and truthfully. Witnessess or any other evidence you think will help prove your case can then be admitted. The judge and the defendant are allowed to ask you questions. After hearing your side of the story, the defendant gets a chance to tell his story. After hearing each side, the judge reaches a decision. The judgement may be immediately given or given within 10 days after the hearing. Last month, a WCU student filed a complaint in the small claims court in Transylvania County, where the person he sued lives. After a copy of the complaint was delivered, the defendant decided to settle the matter outside of court. The WCU student received what was never returned to him--$445 worth of merchandise. This article shows how the small claims court can be beneficial to the average person in resolving relatively small disputes which could otherwise become involved and expensive.
