TRACT 207 AliD 207-A: DILL/lRD W .CALDWELL. l, Both of these tracts;now owned by Dillard w.caldwell,are wholly within the bounds of State Grant 25?. issued to John Gray Blaunt, Nov.29,1796. As the title to the holdings under this grant has been analyzed in detail in the analysis of title to the Sidney Nelson tract,the same will not be repeated herein;but ma; be seen by reference to pages one to ten of this abst:re.ct. l::."-"··"i· TRACT 207 2. The first instrument to be considered in connection with this tract is abond for 50 acres on the hes:i of Spruce Branch,and joining the southeast boundary of Smith's one hundred acre tract. This bond beefs date,May 13,1879,and is from the axecutors of Jas. R. Love to John A.Smith. t:uly recorded in Haywood County See page ~ z ~of thcis abs tract. 3. The ne:xt instrument effecting the title to this tract is a deed fro r: the same executors of J a s. !-.• Love to T. S.Williams for fifty acres by metes and bounds,Jot ning t he J .F. ?almel· tract,which is the s ame tract referl"ed t o in ab rwe -pa r a graph as belonging to Smith. In its recitals,this deed makes mention of the bond to JOhn A.Smith, and the notes in connection therewith ,as having been ·paid to R. V, Welch,who was one of the heirs to the Love estate. ~t is not sta.ted definitely that the deed is b•ing made in compliance with the Smith bond;but th <' reasonable assumption is that it was. This deed bears date, April 10,1890,and is of r aaord in Haywood County. See page .-,:,-T?-&-.of this abstract. 4. Under date,Jan,9,1896,Thomas Willia.ms,who is one and the person as T.S.Williams,by deed in regula~ form,properly executed and r eooried,in Raywood County,conveyed to H.J.Caldwell fifty acres by metes and bounds,the same as in the previous paragraph. No mention is made es to whether Williams was married or single at the time 372 this deed was executed. So we have secured affidavit showing that he was single. See page .. ~'>Of this absteact. See page ;4of this abstract. Tract 207-a 6. The greater oortion of this tract is a.portion of an original one hundred and fifty acre tract conveyea,June 8,1857,t0. Jeose F. Palmer by· Jae.F.Love for himself and Jaa. r .Love and others as execptors of F.Love,deceaeed. There is some question as to the '{)OWer and authority of these grantors. This qnestion,however,has Jjk 7 been discussed in pare graph 3, -p&ge 93 of thi e abstract ,in the anal-ysis of title to the Eldredge Ce.ldwell trvct, to wh1.ch reference is hereby made. Therafter,some time prior to Nover.1ber,l895 Jesse L.Palrner died,leaving as h1s heirs,his w4dow,Mar1 A.PLlmer and twelve children some of whom had married. On rebruary 15,1896,his heirs filed a petition for partition of the lands belonging to J.H.Pe.lmer at his death. This proceeding has been fully treated in the analysis of title to tract 240. On June 30,1896, Elizebeth .Polmer conveyed to lliiary A.Palrner a ·tract of land contain­ing fifty-five acres,being the s vn:e land allotted to Ilizc,beth Palmer in the partition proceedings heretofoer referred to. Since writing the above,it has become appearant that in addition to the chain of title as set out,in this analysis that there is another and conflicting chain of title terminating in the s suncrest Ltlmber company. This arises from the fact that tract 207 as herein before set o ~J t, was . not excepted in the deed from R.D.Gilmer,Trustee for the Love 1ieirs to The North Carolina Land and Lumber Company,dated :·arch 3lst,l898.
