Love to his executors, the same will not be repeated in this analysis, but may be seen by reference to the analysis of title or the Sidney Nelson traot beginning with paragraph one,. through paragraph ten, page three of t his analysis• At the time Traot No., 246 was optioned by the State of North Caro• lina1 Blaine Conard was t he owner, but sinoe that time t here has been a f oreclosure proceeding under a deed in trust executed by Blaine Conard, and at the sale under the dee~ in trust, .r, M. Conard wae t he purchaser; and a deed has been executed to him by the trus·tee 1n t he aforementioned deed of trust conveying to him Tract No. 246• 2.. Tract ·Jo. 246 is embraced in two certain deeds execu• ted by t he Love executors to G. L. Palmer. The first deed bearing date of October 5• 1881, was signed by Viilliam H. Thomas, Robert o,A. Love, William Hilliard and Sa:;.uel L .. Love, executors, to G, L. Palnler. This deed conveys two treats. The second tract in said deed being the land that embraces a portion ot Tract ~ro. 246. In this conver­anoe the Love executors reserve one•half of the mineral interest \'11th mining prfvilege!f• This deed is ot record in Haywood County. see page 213 of t his abstract. -1- 211 3, The second tract conveyed by the Love executors to Cr , L. Palmer which embraces a portion of 11'ract No. 246 bears date ot April 11, 1889, This deed conveys two tracts - the first tract in said deed being the tract that embraQes a portion or Tract No. 24&. One-half of the mineral interest with mining privileges is reserved in t his conveyance, This deed 1 s of record in Haywood county. See page 214 of t his abstract, 4, On October 241 19051 G. ·L. Palmer and wife conveyed to John M. Palmer a tract .of land containing seventy-five acres, more or less, which tract embraces the whole of Tract No. 246. This deed is duly recorded in Haywood County·. See page 216 of this abstract. 5. On December ?, 1925, John M. Palmer and wife conveyed to Blaine Conard Tract No, 246. This deed is of record in Haywood See page 217 of this abstract. 6, On August 13• 1927, Blaine Conard executed and delivered to w. :r. Hannah, as trustee, a deed in trust conveying Tract No, 246. This conveyan"Ce was made to secure an indebtedness of $495,00 due ora Hannah Caldwell.. This deed of trust appears to be in regular form and duly executed. However, we notice that it is executed by .Blaine Conard alone, and does not show in the pre~ble nor the certificate whether Blaine Conard was single at the date of the execution of this deed in trust. This deed of trust is recorded in Haywood County. See page 218 of this abstract. 7. On August 26, 1929 1 w.
