WCU Students Face Charges in Hensley Case by James Carter "Detectives have taken warrants out" on a number of WCU students who were involved in the late-night party at Lake Glenville that resulted in the death of Timothy Hensley in September, according to Jackson County District Attorney Bob Clark. The Jackson County Clerk of Court office confirms Clark's statement and has records showing that WCU students Phillip Davis, Blake Booher, and Peter Saless, all 18 years old, and Jonathan Stephens, 20, were charged with possession of a malt beverage and/or possession of a spirituous liquor. All four students have since posted a $2,000 secure bond. Jason Payne, a 22-year-old native of Hot Springs, Saless' hometown, paid a $1,000 bond for different charges. Payne, a currently enrolled student at Western, was charged with sale of spirituous liquor to a person under 21 years of age. Payne's warrant reads that he did "willfully g[i]ve one gallon of Aristocrat Vodka, 1/5 of Arrow Peach Schnapps, 1/5 of Malibu Caribbean Rum, a spirituous liquor, to Phillip Davis, who was at the time under 21 years of age." Further charges have recently been brought against these students, and other students involved have been served as well. Payne has been additionally charged with selling and/or delivery of alcohol to a person underage. Stephens has been further charged with contributing to the delinquency of a minor and aiding and abetting the use of malt beverages and spirituous liquor. Saless has also been charged with contributing to the delinquency of a minor and aiding and abetting of use of a malt beverage and spirituous liquor. Booher and Davis share those charges and are further charged with falsely reporting to a law officer. Further charges are as follows: • Adrian Jellie, 21, is charged with selling and/or delivery of malt beverages to underage persons. • David Forrester, 18, has been charged with falsely reporting to a law officer and aiding and abetting the use of malt beverages and spirituous liquors. • Rebecca Hensley, the deceased's sister, has also been charged. She faces possession of malt beverage and spirituous liquor charges, contributing to the delinquency of a minor, and aiding and abetting charges. • Joyce Carver, a former student, has been charged with underage possession of alcohol, the aiding and abetting charges, and also with contributing to the delinquency of a minor. As of Monday, September 30, Michael Derwnoski was the only other person charged in connection with the case. Derwnoski, 18, has been charged with possession of a malt beverage and possession of spirituous liquor. He also faces contributing to the delinquency of a minor and aiding and abetting charges. Bill Haggard, dean of Student Development, says that WCU "has not yet closed the door on the off-campus violations," and that the students will face more consequences if it is found that any of the illegal activities took place on campus. Both Haggard and Detective Darrin Young, who is handling the case, say that the investigation is ongoing. The Silent Minority by Summer Rogers Forty minutes away from the WCU campus, the Cherokee Indian Reservation is home to about 100 Western students. Taking this into consideration, it would seem that this minority would play a larger role in Western's culture on campus. The reality is, however, that there are very few Cherokee involved in campus life as compared to the average student. There are many factors in this, one being the presence of the WCU campus at Cherokee. This extension is set up to teach general education to Cherokees, as well as others. The program was started in 1975 as a starting point for Cherokee teachers. According to Jim Farris, current academic advisor to Cherokee students, at the time, Cherokee were only active in public schools as teacher's aides, janitorial staff, and kitchen help; all of the actual teachers were white. Therefore, out of necessity, the Cherokee grant-funded program was set up to allow future teachers to take classes toward their certificates at night while still keeping their day jobs. After the students went as far as the Cherokee branch could take them, they were forced to quit their jobs and go to WCU to finish as full-time students. Twenty- five students started that original program; 15 attained degrees. Keeping the history of the resident credit center in mind, the current situation of the average Cherokee student can be understood from much the same perspective. Most Cherokee are not traditional students, according to Farris. Generally speaking, most are females who have reassessed their situations after getting married and beginning families and have decided that higher education is the best way to better their lives. Others are single mothers and nontra- ditional men, who are concerned not only with getting a degree but also with keeping their jobs and their families secure. Keeping this in mind, the Cherokee center is geared toward providing classes and services that are especially convenient "Silent" continues on page 2 WWCU Genera! Manager Suspended Chart from the WCU Factbook. by Terry K. Roberts Phillip Drum, general manager of WCU's campus radio station WWCU, was suspended with pay on Friday, September 26, pending an appeal. Drum has ten days to respond to accusations that he was responsible for physical abuse and for drinking at the radio station. In a September 30 interview with the Carolinian, Drume stated that he plans to appeal the decision handed down by Student Development. Drum said that his only accuser was his ex-girlfriend. Drum says he was accused of drinking while on-air. 'There is no actual proof that I was drinking at the radio at the station," he stated. "It's her word against my word, and I have a person I was up there with, a DJ,... we were doing a show together, so it's basically my word and his word against this other person's word. "I was not drinking in the radio station," Drum said. Vice Chancellor for Student Development Bonita Jacobs stated, "I am the person to whom he appeals ... and he is not to be at the radio station, pending the outcome of the appeal." Matt Johnson, program director for WWCU, has assumed the general manager's duties temporarily. According to the WCU Personal Safety and Drug and Alcohol Policies 1997- 98, students are not allowed to consume or possess alcoholic beverages in campus buildings, other than "1. the campus residence of students, employees, and guests; and 2. any campus area for which an appropriate permit has been issued by the North Carolina Alcoholic Beverage Control Commission."
