  • TRACT NO. 305- R. T. BOYD AND C. M. MOODY THE TITLE The original 50 acre tract of which No. 305 is a part is embraced wholly within the bounds of State Grant 252, issued to Joftn Gray Blount on November 29, 1796. Title to the lands covered by this grant became vested in Robert Love and James R. Love under a deed bearing date December 20th, 1834, and became a part of what is generally known as Love Speculation Lands. The records disclose a regular recorded chain of title to this tract down to the present owners, the said R. T. Boyd and C. M. Moody. In addition thereto the said Boyd and Moody and those under whom they claim have been in the adverse possession of this tract under known and visible boundaries for a sufficient xjoeb period of time to have matured title thereto under the statute of North Carolina. However, Tract 305 is covered by a lappage claimed by Suncrest Lumber Company. Inquiry in the neighborhood discloses that no other person except suncrest Lumber Company has set up any claim to this tract. There are no valid outstanding liens or encumbrances. All taxes have been paid. All deeds are general warranty deeds and purport to convey title in fee. In order to clarify the situation relative to the above mentioned lappage all persons necessary were made parties in a condemnation suit, brought in the Superior Court of Buncombe County, before the Clerk, entitled, ""State of North Carolina vs. Suncrest Lumber Company*. This suit is still pending. When necessary action is taken in this matter the smae will be made a part of this abstract.
