From t he records , it a pp ears that both parties f a il to c amply with the contract above mentioned, {see ~: l'? age 56 i"- c_ot this abstract), and that about t h e year 1889, w. L. On October 7, 1890, the Scot t ish - Carolina Timber and Land com9a ny conveyed to William ? • 1Uexander all the land t hey had been declared the owners of in fee in the case of W. L. How e v ~ r, before his death, he made and published his last will and t estament. In said will, Alice Hamer Alexander, John Alexander, Duncan McKinnon and J ames Hinton Robertson were named executors and trustees. pA.ff st..f f~/~ o.f.sh--a..~f- 10.. On April 22 1 1905, t he above narned executors and trustees of t he last will of William P . Alexander oon veyed to J. M. McHae two boundaries of land. The des cri ption conta i ne ,.l i n t his de ed embraces Tracts Nos. 227-a and 227-b. This deed is si gn ed and aoknowl .edged by all the executors, but doe s not contain covenants _of any kind. This deed also lacks the usual covenants. It is of record i n Haywood County. See Page 5?2 of t his abstract. 12. Eventually some doubt arose as to t he suffi cienoy of' the deed of Paragr aph 10 above, rel nti ve to the individua l interests of .Al. :t ce Alexander and Wi lliam Boyd .t\.lexander, widow, and only child,· " respectively, of Willirun P . See Page 5?3 of this abstract. 13. On the following day, Februa ry 15, 1910, J. M. McRae executed a quit cl aim deed covering t he same lands as previously conveyed by him to t he Laurel l!"'ork Lumber Company. The descr iption embraces the Ca taloochee and Mt. Sterling Tracts . This deed is properly executed and of record in Haywood Count y. :see Page 5?7 of t his abstract. 15. Even tually a gain some que stion arose as to t he sufficiency of the Alexander deeds to J. M. :MoRae and as to t he MoRae deeds to the Laurel Ji'ork Lumber Company ,none of which con t ai n the usual covenants. Conse quently, on Au,sust 13, 1910, J. M. And defendant avers that but for the expectation of getting immediate possession ot said lands and ti~ ber thereon, the said lands would not have been considered baluable, and in taot defendant would not have pt'lid· half the price asked tor the same; and as said plaintitt failed to survey and locate the same in time for use as aforesaid, the lands woUld now be worthless to defendant tor any purposes they were intended at the time of the said alleged agreement, and it would be inequitable and unjust t<? compel the defendant to take t hem now at any price.
