  • TRACT NO. 304 - P. W. MeHAFFEY THE TITLE This tract is a small part of an original 100-acre tract that lies on the Cataloochee side of the divide between Catalooohee Creek and Johnathans Creek. It is covered entirely by State &rant No. 252, issued to John Gray Blount on November 29, 1796. Title to the lands held under this grant became vested in Robert Love and James R. Love by reason of the execution of a deed bearing date December 20, 1834, and became a part of what is generally known as the Love Speculation Lands. The records fail to disclose a full record chain of title to this tract, however, this tract has been held continuously under a deed bearing date August 2nd, 1881, down to the present owner, P. W. MeHaffey. Same has been held in open,adverse possession from the above mentioned date by the said MeHaffey, the present owner. However, Tract 304 is covered by lappage claim under junior deed by Suncrest Lumber Company. Inquiry in the neighborhood discloses that no other person, except the Suncrest Lumber Company, has set up claim of any nature to this tract. There are no valid outstanding liens or encumbrances. All deeds are general warranty deeds and purport to convey title in fee simple. All taxes have been paid. In order to clarify the situation relative to the above mentioned lappage all persons necessary were made parties in a condemnation suit brought in the Superior Court of Buncombe County, before the Clerk, entitled, "State of North Carolina vs. Suncrest Lumber Company, et alrt.
