  • Are Residents Subject to Unannounced Room Searches...Without a Warrant? Housing denies such searches, student says otherwise Johnathan Jones Staff Reporter The nonnegotiable housing contract states under Section E of the general policies and procedures, "The University reserves the right of entry into a student's room during an emergency or for other purposes in accordance with University policy." Article 6, Section B, of the Student Bill of Rights states, "The institution shall not consent to nor institute a search of a student room without a properly executed search warrant." According to Karinda Rankin, Hill Area Coordinator, "The policies and procedures were created in a way to help educate students on what is appropriate behavior." So, the University has the power to search a student's room. However, Randy Rice, Director of Housing, said, "We don't do searches. If we think something illegal is going on, we turn it over to Public Safety and let them go after a warrant." Kerry Wedgewood, a resident of Walker, had her room searched on January 23. According to her neighbor, Melissa McDuffie, Rice and Linda Riouff, the Area Coordinator, questioned her on whether Wedgewood's boyfriend had been living in the dorm According to Randy Rice, Director of Housing, "We don't do searches. If we think something illegal is going on, we turn it over to Public Safety and let them go after a warrant." with her. McDuffie said, "After I said I had seen him around, they keyed into her room, and closed the door behind them. I could hear drawers and the closets being opened and closed. It sounded like they were searching the room to me." Ashley Hubbell, another one of Wedgewood's neighbors, said, "I heard Randy Rice and L.C. (Riouff) go in the room and close the door. "Then," Hubbell continued, "Randy came over to my room and walked on in. He asked me if I knew that Kerry's boyfriend lived on the hall. I told him that a lot of people have guys spend the night. Then he asked me when was the last time I had a guy spend the night. "He didn't tell me who he was or why he was in my room uninvited, and I didn't see L.C. standing behind him. I said that it was none of his business, and he got upset and left," Hubbell said. When asked about the Wedgewood incident, Rice said, "We did not search that room. We had been told that a male non-student had been living in the room with her. We didn't search the room, or touch an item at all. "We were told that he was in the room at that time," Rice continued, "and that is why we entered the room. I don't think we closed the door. It may have gotten pushed to. "We didn't open any drawers at all. We just kind of looked around to see if there I was any sign of someone else living in the room. And by going in, we discovered no indication of someone else living there," Rice said. "We weren't in the room hardly sixty seconds," Rice continued. "And that's probably the only room I've been in all year."
