What To Do If You Get Pulled It is not an uncommon occurrence for a student to have to deal with the police; however, a large number of students are not aware of their rights when stopped, arrested or searched by the police. When you are stopped by the police, you should ask why you are being stopped. If the police do not place you under arrest, you can leave at any time. According to the North Carolina Civil Liberties Union, when you are stopped you do not have to tell anything to the police. If the police will not allow you to leave, you are under arrest. Demand to be taken before a magistrate or released. When you are arrested, you have the right to remain silent. Make no statements until you have talked to a lawyer. You also have the right to be taken before a magistrate and a bond must be set. At that time you should ask to be released upon your signature. This process is called being "recognized." A magistrate does not have to do this, but you can ask him to set a low bond or to recognize you. The magistrate, not the police officer, sets the bond. If you are in the service, ask to be released to the military police. Every person who is arrested has the right to a lawyer and should find a lawyer immediately. If you can afford a lawyer, you may contact the lawyer of your choice. If you cannot afford to hire a lawyer, you have the right to a free lawyer. This lawyer is called a public defender. If you demand to see a public defender, the police or magistrate will contact one for you. You have the right to see a lawyer as soon as you are arrested, and you should insist upon this right. Your lawyer can advise you about your case and help you get a reasonable bond. Anything you say to the police can be used against you in court. Everything you tell your lawyer is confidential and cannot be used against you. Following an arrest you can telephone family, friends, your lawyer, or a bondsman. Under no circumstances should you physically resist an officer. It is likely that such action would only cause more trouble and could possibly result in additional charges. If the police want to search you, your house or your car. the N.C. Civil Liberties Union recommends that you should tell the police politely and clearly that you object to their searching. Evidence taken by an illegal search cannot be used against you in court unless you consent to the search, so therefore N.C. CLU says. "Don't." On the other hand, ihe police can seize anything in their plain view. Thus, it is generally better not to throw anything away. You cannot object to a legal search or seizure of anything thrown away.
