acquire good and perfect title to the property, and shall authorize said condemnation proceedings to be instituted. The power of eminent domain, hereby conferred, shall be exercised under and in pursuance of the provisions of Section 1325 to Section 1348 of the Code of 1858, except: (1) There may be included, in any one proceeding, as many tracts of land, each of which are wholly, or in substantial part, in the same county with the other tracts, as the Attorney-General may direct; but the actions taken against the owners of each tract, and the awards with reference thereto, shall be separate. (2) The right of eminent domain, herein conferred, shall be limited to a period of five years from the date of the passage of this Act, and thereafter, such right shall cease. (3) The right of eminent domain, herein conferred, shall be limited to the following area within that described in the preamble of this Act, to-wit: The area of One Hundred and Fifty-Four Thousand (154,000) acres, exclusive of the Little River Lumber Company tract of land of about Seventy-Six Thousand (76,000) acres lying between the North Carolina-Tennessee State line and the black line on the map hereinafter referred to and designated as "Northern boundary of Park as recommended by Great Smoky Mountain Conservation Association," and between Little Tennessee River on the Southwest, and the Big Pigeon River on the Northeast, which the Secretary of the Interior may select, to be included in the Great Smoky Mountain National Park, under the provisions of the Act of Congress, which said area is more particularly described and set out on a map prepared by the United States Geological Survey for the Southern Appalachian National Park Commission, entitled, "Proposed Great Smoky Mountains National Park—North Carolina-Tennessee," and on which said map the boundaries for the part of said proposed National Park, lying within Tennessee have been indicated by black, lines, and by the North Carolina-Tennessee State line by the Great Smoky Mountain Conservation Assoc- —16—

Senate bill 781 was presented to the 65th General Assembly of Tennessee to establish the “Tennessee Great Smoky Mountains Park Commission" for the purpose of establishing the Great Smoky Mountains National Park. The U.S. Congress had agreed to create the park only if the states acquired the land. In 1924, North Carolina established the North Carolina Park Commission to set boundaries and purchase land. By 1931, both North Carolina and Tennessee had acquired over 100,000 acres that were deeded to the federal government and placed under the management of the Secretary of the Interior.
