  • such of said bonds as can be taken up with the monies then on hand in said sinking fund, provided only that such bonds shall be purchased at or below par. SECTION 16. BE IT FURTHER ENACTED, That the "Tennessee Great Smoky Mountains Park Fund," hereinbefore provided for, when made available in accordance with the provisions of this Act, shall be paid out by the Treasurer upon proper vouchers issued by the said Park Commission, provided, the State Comptroller shall approve the same, only when evidence is furnished that the same has been expended in accordance with the provisions of this Act, and all conditions complied with which authorize the expenditure. SECTION 17. BE IT FURTHER ENACTED, That the funds derived from the sale of bonds authorized by this Act shall be devoted wholly to the acquisition of lands lying within the State of Tennessee, within the boundary hereinbefore designated. No part of the proceeds of this bond issue shall be expended in the acquisition of any property until the United States Government, through its duly authorized officials and agents, has formally signified its intention and willingness to accept and establish a National Park in the Smoky Mountains. SECTION 18. BE IT FURTHER ENACTED, That notwithstanding any of the proceeding provisions hereof, no bonds shall be issued and no part of the funds to be derived therefrom shall be expended until it shall have been made to appear to said Commission: (a) That the Secretary of the Interior has, in pursuance of the Act of Congress, agreed in writing to accept the areas to be acquired within the State of Tennessee and North Carolina suitable for general development for National Park purposes, as provided in said Act of Congress. (b) That adequate financial provision has been made by or on behalf of the State of North Carolina for the purchase of its portion of the desiginated area lying within the State of North Carolina set forth in the preamble hereof. —14—
