  • The^festef n Carolinian THURSDAY,DECEMBER 1, 1977 Vol.XLIII, No. 14 CULLOWHEE,N.C. Chairman Cates9 life threatened Voter registration challenged by EDDIE YANDLE l was made on the life of a student senate committee r registration A threatening phone ( Phillip Cates. chairman c (ad hoc) which is studying commuter v in Jackson County. The phone call came Monday night at approximately 10:35 p.m. telling Cates "lo get his nose out of Jackson County matters or your ass is dead." Cates said the committee is studying a system Utilized by the county which requires students of WCU to fill out a special three page questionnaire regarding private aspects of their lives. The document has no federal, slate or local title numbers which further adds to the committee's suspicions. The committee is challenging the constitutionality of the questionnaire since only WCU students are required to fill it out and the document is not open to public record. A request was made by the committee to view the document about two weeks ago in the form of a letter, but no reply was recieved. As a result, members of the committee including Cates, Vice-Chairman Mark Williams, Chip Hicks, SGA President Patrick Murphy, Vice-President Gary Brown and Legal Assistant Luther Hollingsworth, went to the Board of Elections office and again requested the form. Cates. who is College Republican president, Senate Pro-Tern, and a Western Carolinian staff writer, showed Superintendent of Elections Eva Green'a letter from the Attorney General's office which stated that such documents are of public record according to the North Carolina "Open Meetings law." Mrs. Green still refused to hand over the form, saying she was under orders of the Chairman of the State Board of Elections.' Alex Brock, not to release it. Mrs. Green said further that the only way to see the document would be through County Attorney Creighton "Zeke" Sossomon who was not present at the time. The group also called Brock in Raleigh who was also unavailable for comment at the time but Cates said. "We will call him again tomorrow." The committee is also planning to work with the League of Women Voters who have already had several confrontations with the county. The committee will meet with the LWV Tuesday- night because, Cates said. "Since both of our directions are non-partisan we will probably combine efforts." Phillip During a Cates discusses Jackson County voter registration yesterday with Eva Green in Sylva. iceting Tuesday afternoon, Cates informed ;c of the threat on his life and also gave a synopsis of what the group has done up till then. Opinions were expressed by each member, beginning with Vice-Chairman Williams who said, "The very act of threatening a member of this committee suggests that we are approaching a very sensitive area in the Jackson County political system." President Murphy expressed concern over the problem as well, saying, "...they (the ad hoc committee) represent the student body of Western and have the full support of the student senate and the executive branch of the student government. We will not back down in this support..." Criticism of the system was given by Vice-President Brown at the meeting who said, "...a life-long resident of Jackson County was subjected to uncalled for questioning and scrutiny when he attempted to register merely because he was a student at WCU." Chip Hicks felt the action should be against the entire group, not just one member. "If anyone can find something to blame in our actions let them face us all and not single out one member." The threat on Cates' life didn't phase committee member Thornton Wooding who said, "My interest in seeing this matter through will not be deterred by a threat on Chairman Cates' life or my own." Legal advice was sought by the committee through both Legal Advisor Hollingsworth and Cates' personal attorney George Kaneklides. Hollingsworth. who accompanied the group to the Board of Elections office Wednesday said. "It is mv opinion that a situation has existed and still does exist for a lawsuit against Jackson County." He was supported by attorney Kaneklides who said in a letter to Cates that "...when anyone goes to register to vote il is a mere application of registration." Senator accused of seeking publicity A bill proposing an additional allotment of c parking spaces was proposed in last week's senate meeting bv Sen. Al Lagano that was termed a "publicity stunt" by several other senators. The bill, requesting 50 parking spaces be set aside for commuters in the Old Memorial parking lot. had already been planned by the executive branch of SGA. according to one senator. The senator went further to say. "The bill originated after Patrick (Murphy. President) and Gary (Brown, Vice-President) and other members of the executive staff had already done a survey on parking in the Memorial lot. They had already submitted it to Traffic- Security Committee so it was well planned and the administration had already basically accepted it." Sen. Lagano said that he was unaware of the work that had been done until he had already written the bill. "I decided to write the bill because I got a ticket down there for parking, so I wrote a bill so anybody could park there. Then Pat told me there was a orking to add about 50 more spaces so I rewrote the bill to go along with his. I had already submitted the bill and Wanda Nelson knew something else about it so I withdrew it." Lagano said.
