XXXIX NO. 53 THURSDAY APRIL 25, 1974 WESTERN CAROLINA UNIVERSITY CULLOWHEE, NORTH CAROLINA Court rejects candidate's pleas In a 5-0 decision the student supreme court said Tuesday night the student senate acted constitutionally in taking Wardell Townsend's name off the ballot of the SGA presidential election last week. The senate based its action on Townsend's failure to meet the qualifications for candidacy sine he was not a full- time student fall quarter. Townsend had filed suit against the senate and the senate's election committee charging that it could not take his name off the ballot. To be a qualified candidate, a student must have been a full-time enrolled student for three quarters prior to the election. To be considered "full-time" a student must complete 12 credit hours each quarter. Townsend said he registered for 14 hours in fall quarter, but withdrew from a four-hour course near the end of the quarter. Townsend contended in court that since he received no refund when he withdrew from the course he was still a full-time student. In the decision handed down by Chief Justice David Fowler, the high court said ''the student senate acted within their constitutional rights in the denial of Mr. Townsend a place on the presidential ballot." The five other justices ruling on the case were Warren Webb, Karen Moore, Ron Rhodes, Ray Stewart, and John Hyatt. Robert Johnson, Townsend's student attorney, told the court Tuesday night that being a candidate for student body president was a "privilege that is bought by the payment of fees." He said since Townsend had paid his fees he should be allowed on the ballot regardless of the number of hours he completed. However, Attorney General Hal Harrison, who defended the senate, said it was clear Town- send was not a full-time student and the senate's action was legal. Harrison cited the SGA constitution statingthe "senate was the judge of the elections." Johnston countered that eight dollars of a student's fees went to SGA. If he were part-time, the money should have been returned to Townsend when he withdrew from the course, Johnson said. He said Townsend received no money back from SGA so it must have considered him a full-time student. Yesterday Student Body- President Harold Rogers said Townsend had told no one he had been a part-time student fall quarter. Rogers said if he had known about Townsend's withdrawal he would have made him resign and turn over his .$250 stipend. Both Townsend and the Attorney General asked for a court opinion on full-time status for future use. Chief Justice Fowler emphasized that the definition of full-time student was not the basis of the decision. The only question Townsend Board to reverse Four terminations has asked was wnether the senate's action was constitutional, Fowler said. To be considered a full-time student, the court said, "the student must register for 12 or more quarter hours and maintain 12 or more quarter hours throughout the quarter in order to be considered a full-time student. "AH courses in the Western Ca -olina Record are included. Graduate students in Arts and Sciences are considered full- time students if they are carrying nine or more quarter hours. "Graduate students in the M,B.A0 program are considered full-time students if they carry eight or more quarter hours. This definition shall serve as precedence in the future." Four of the eight faculty members appealing tenure decisions were informed yesterday that the previous decision to terminate their employment will be reconsideredbythe WCU Bofcrd of Trustees on May 10. James Kasprzak of the English Department, Joseph W. Dodson aid Jack C, Sharp of the Mj.:h Department, and Blaine Eldrige of the Art Department, received letters from Acting Chancellor Frank Brown stating that the hearing committee of the Board of Trustees intends to recommend to the full board "that the previous decision to terminate employment be reversed " If the trustees accept the recommendation of the special tenure appeals committee, the matter will go to the UNC Board of Governors for final action. Donna Clemmer and Jim Davidson are on the ballot for president. Charles Mackie and Roland Johnson will both be attempting to win the vice presidential race;. Both contests were thrown into a run-off when no candidate received a majority of the votes cast last week. However, he said "there was no mention of defect" during his work with the committee, The special committee was made up of trustees Hugh E, Gentry, John Gloyne and Hazen Ledford, The four who received the notices of possible reversal of termination took the news with a grain of salt. Eldrige said he was "pleasantly surprised" but he expressed reservations about the hope of tenure. Sharp said he would "wait and see," and the others showed similar sentiments. The other professors who appealed their tenure cases, Alan Grant and Newton Smith in Eng<» lish, Andrzej Weilhorski in Art and Merlin Berry in History, were notified yesterday -hat the previous decisions would be upheld. Except for Weilhorski, who has a terminal contract for next year, this means termination in June,, . Grant, Smith and Weilhorski plan to continue their appeals. Weilhorski said he was "in shock" about the actims of the committee. He feels his was a case of "overt discrimination," and will appeal further. The show plays through Saturday night. opens tonight in WCU's Hoey (Photo by Bill Melnr.yre) Noted librarian Jesse Shera Will dedicate WCU archive wing Dr, Jesse H, Shera of Cleveland, Ohio, top authority on American libraries, will visit WCU Monday through Wednesdav (April 29-May 1) for the dedication of the Archives and Special Collections Room of Hunter Library, A former chief of the census library project at the Library of Congress, Dr. Shera was also deputy chief of the central information division of the research and analysis branch of the Office of Strategic Services. He holds a B.A. degree from Miami University, M,A. from Y'ale University, and a Ph. D. in library science from the University of Chicago. Dr. Shera has been a consultant to the Bureau of the Census and the Office of Education and an official representative of the Department of State and the National Science Foundation to international bibliographic conferences,, Past president of the Ohio Library Association and the Association of American Library Schools, he ho s served as editor of the "Library Quarterly," "American Documentation," and the "Journal of Cataloging and Classification/' A leading educator in the field of library science, he has authored or edited over 150 articles, 100 books reviews and 11 monographs, On Monday, Dr, Shera will deliver a lecture of a group of media science majors and consult Tuesday with library faculty and staff and university administrators on plans for Western's new library building- During dedication ceremonies from 2 to 4 p.m, Tuesday, he will deliver an address on "From Manuscripts to Books," in Hunter Library, His visit will conclude Wednesday with a talk on "Where Is Lib- rarianship Going?" during a colloquium on the future of library services from 10 a.m. to noon in the auditorium of Forsyth Building, Both addresses are open to the public,
