  • Carter Signs Privacy Act H\ Jim Buchanan Staff Writer Ihe Privacy Protection Act of 19H0 was signed into law on October 14. This ad is the aftermath ol legislation proposed last year concerning the U. S. Supreme Court ruling in the Zurcher vs. Stanford Daily trial. The ruling upheld a decision that a search of the newspaper office for photos of a campus demonstration in 1971 was legal, even though no one at the newspaper was guilty or even suspected of any crimes. President Carter established himself as a proponent of individual rights List vear. when addressing Congress he slated. "We confront threats to privacy undreamed of 200 years ago. Private conversations are often conducted by telephone. Many personal records are held by institutions, such as banks and government agencies, and the Supreme Court has held that the individual has no constitutional rights over such records. Important judgements about people -such as the decision lo extend credit or write an insurance policy—are often made by strangers, on lhc basis of recorded data." The aftermath of the trial and the president's reaction to it was the adoption of two measures that form the basis of the first comprehensive privacy policy. One measure was the Privacy Protection Act, and the other is that the Justice Department has issued rules prohibiting closing judicial trials or other proceedings in almost all cases. Permission would have to be granted by one of the top three officials in the Justice Department. Other privacv acts that have been recently passed include the Right to Financial Privacy Act, which restricts federal access to private bank records, and the Foreign Intelligence Surveillance Act. which will help limit the use of wiretaps. Other Acts that have been presented before Congress dealing with individual privacy but have not been acted upon are the Privacy of Medical Information Act. the Fair Financial Information Act. the Privacy of Research Records Act. and Privacy of Electronic Funds Transfer Act. The Privacy Protection Act forbids searches by government officials of individuals who are engaged in I si Amendment activities (writers, reporters, scholars, etc.) without voluntary permission or a subpeona.
