C-- Lawsuit filed Board.of Commissioners has 30 days Ik SYLVA—Resident Superior Court Judge Lacy Thorn- burg yesterday granted a public hearing for 3:30 p.m. Sept. 19 in the county courthouse here in connection with a class-action lawsuit filed last week against the Jackson County Board of Commissioners by the Jackson County League of Women Voters and its president, Ms. Veronica Nicholas. The league alleges that the board illegally barred the public from five meetings since May, and that the board and its accountant, Dan K. Dictz, have illegally withheld public documents from public view. The hearing is scheduled to concern a related temporary injuction to prevent the board and its associates from continuing to allegedly violate North Carolina's open meeting or "sunshine laws." The board now has 23 days to respond to the charges. County Attorney Creighton W. "Zeke" Sossomon said Monday he has received a copy of the charges and is preparing a response. He refused to comment further. The lawsuit alleges: •That a number of people were not admitted to a 10 a.m. May 2 board meeting until 11:15 a.m.; •That the board and the Jackson County School Board privately discussed a $3.9 million school bond issue in a restaurant here on June 6, that the board secretly met and set a date for the referendum immediately afterward, and that no public notice was provided for either meeting; •That 48 hours public notice was not made for a June 22 special meeting of the board, and that the board went iion and asked Ms. Nicholas to leave without voting on the matter; that the same thing happened at June 2b and Aug. 1 board meetings; •That the league was denied access to the county audit report for fiscal 1975-76 from April until June 20, 1977 by dietz, and that Dictz denied Ms. Nicholas access "to any documents or reports that would indicate the amount of money which had been expended in the current fiscal year or until that time on the plans and construction of the Jackson County Airport;" (Ms. Nicholas presided over the "Citizens Against the Airport," a group which in 1975 filed a civil suit to stop construction on the Jackson County Airport and obtained a preliminary injuction halting work on the project from Judge Thornburg, who three months later lifted it. The group lost the suit). •That the league was denied access to the "working minutes" taken at board meetings. The league also asks that the defendents be taxed with the cost of the lawsuit. Ms. Nicholas said she named herself as co-plaintiff in case the league cannot technically bring suit. The action is being funded by the education fund of the national League of Women Voters, and was approved unanimously by the local league. Ms. Carolyn McAllister, a Durham attorney, is representing the league. Board chairman and only full-time paid County Commissioner Bruce Wike and Dietz refused to comment. Ground movement has begun to open deep cracks in the runway atop Berry Ridge. [Clark]
