Deadline for registering to vote in the May 7 primary election is April 8. Western Carolina students wanting to vote in Jackson County must register at the Board of Elections office in the county courthouse in Sylva. The final election will be on Nov. 5, but the state legislature decided to hold the primaries in May. If a voter has already registered for a previous election, he is not required to register again. Voters will soon know who the candidates for office will be. Filing deadline for all elective positions is Feb. 25. In Jackson County, elections will be for sheriff, register of deeds, clerk of court and solicitor. One full-time and two part-time county commissioners, and the school board seats will also be elected. The school board seats are in the Cullowhee, Sylva North Ward, and Scott's Creek districts. All state representatives and senators will be elected. U.S. Senator Sam Ervin's seat will also be up for grabs, as will all 11 district seats for the U.S. House of Representatives, To qualify to vote in Jackson County, one must be 18 and have been born in the United States or be a naturalized citizen. He must be a resident of North Carolina and have lived within a precinct for 30 days and never have been convicted of a felony. About 50 WCU students were not allowed to register last year for the November referendum on liquor-by-the-drink because their parents did not live in the county. The students were told by Mrs, Eva Green, election registrar, they could not register because they had no intention of staying in the county after graduation, and they were here only to get an education. Most students tried to register so close to the deadline that they did not have time to appeal the registrar's decision to the three-member board of elections. Alex Brack, state chairman of elections, said at the time last October the students could appeal directly to the North Carolina Supreme Court if they were not satisfied with the local board's decision. Mrs. Green said, yesterday that only a few students appealed to the board. She knew of no one who had appealed the board's decision in court. DZ played Phi Mu a week ago and won with a score of 20-15, it played AXD also and lost. TX has planned a small Valentine's Party for the residents of Webster's Nursing Home in Sylva. The 74-75 student Handbook editors are Debbie House, editor and Karen Congdon, coedi- tor. DZ won the sorority United Fund Drive of Jackson County, It has inducted 9 new pledges: Celia Beard, from ST. Petersburg; Gwen Bunch, Miami Springs; Linda Christopher, Hickory; Jeannette Murphy, Miami Springs; Marilyn Kruse, Ft. Lauderdale; Marlene Strand of Fayetteville; Laura Moore, Ivanhoe; Robin Williams, Ash- boro; Jennie Cannon, Spartanburg. couraged students to appeal the election board's decisions, but the PS-LA drive seems to have ended. Several students have accused the board of illegally trying to keep them from voting. Apparently no local politician has gone out of his way to allow students to register. Understandably, the poli- ucians nave always been wary of sudden changes in the voting populace, and if the entire student body of WCU voted in Jackson County, the Cullowhee precinct could almost control the local elections. Some local politicians willingly admit they are afraid of the student vote. But they also adamantly maintain they have a just greviance in excluding student voters. A classic argument is that students would approve every referendum that would entail a tax hike, but they would not be the ones to pay for it. In Jackson County some elections have less than 5000 people voting. If the number of voters suddenly doubled, the election results would be anyone's guess. Brock said the state policy for student voters was based on a 1972 Supreme Court ruling that said "students shall not be registered in counties in which they are temporarily residing." Brock said the main question centered around where the student's "domicile" was. He said a domicile was a person's permanent residence, not necessarily where he happened to be residing atany given time. According to Brock, if a student can prove his current residence in his domicile,, he is legally entitled to vote in that county. Brock cited four questions that were considered in determining whether a student's residence was his domicile: 1, Did one leave his father's home for the temporary purpose of school, or for cutting loose from home ties? 2, If one was to fail at the college or university or be forced to discontinue his education, would he return to his parents' home? 3, Would one be living in the college town if the school were not there? ' 4. For what purposes other than education did one go to the college town? Brock said each case would have to be viewed individually under those standards.
