  • page 2 THE WESTERN CAROLINIAN Thursday October 25, 1973 Know Your Rights If You 're Busted by David Venable In the past few weeks several students of WCU have been arrested for drug-related offenses. What would you do if you got busted? Would you know your legal rights as a citizen and how to use them? William Scott, head of the Business Law Deoartment and legal counsel for the University, was very helpful in clarifying some of these questions. Have you ever been stopped by the police for a routine offense and they have asked if they could search your car or your person? Technically, with out a search warrant an officer of the law cannot legally search your car or your person, but he can hold you on suspicion while he calls in and requests a search warrant. To get a search warrant an officer must have enough probable cause to persuade a judge to sign the warrant. The issuing of the warrant is entirely at the discretion of the judge, and usually the officer will not request the search warrant with out a strong suspicion that there is something to be uncovered in the search. If the narcotics agents come to your dorm room, trailer, or apartment, you can be 99% sure that they already have either a search warrant or a warrant for your arrest. If you are arrested the arresting officer must tell you your rights before any type of questioning may begin. To avoid any deeper legal trouble you may announce to them that you refuse to answer any questions without the presence of your lawyer. You will be, more than likely, placed in jail and your bond will be set according to the crime and depending on the judge. Usually there are set amounts for the bond according to the severity of the offense. You are allowed one phone call with which you should try to get a bondsman to supply the ne essary funds to free you from jaul. In large cities there are professional bondsmen who grant bond for a fee. The professional bondsman is usually the owner of large amounts of real estate which he uses as collateral for the bond. The fee is usually $lo for the first $100 of the bond and $5 for each additional $100. For example, if your bond is $1000 you would pay the bondsman a fee of $55; Now if you get "popped" in some place like Sylva or Cullowhee you should call someone who owns some property who will put it up for collateral for you, or you might spend some lonely, tearful days in a jail cell. With the help of an experienced lawyer, you can usually have your trial date postponed or set up earlier, depending on the legal tactics your counsel uses. If he knows a particularjudgeishard on drug cases, then he might want to postpone the trial until a more suitable judge can preside over your ease. If possible, try to obtain the services of an attorney who has had experience with drug related cases. His experience might save you some added grief. The basic penalty scheme under the North Carolina Con- troled Substances Actof 1971 defines the varying digrees of punishment for the different types of drugs. Schedule I substances include heroin and LSD, which carry the same penalties and fines for both possession and sale.
