  • iation, through General Frank Maloney, in his recommendations to the director of the National Park Service Interior Department, Washington, D. C. as setting out the boundaries within which, in Tennessee, said proposed National Park should be established, which said map has been forwarded on April 21st, 1927, to said Park Official at Washington, D. C. as Exhibit "A" to said recommendations, an exact copy of which said map indicating said boundaries, is lodged and filed with the Register of Deeds of Sevier County, Tennessee; and no right, in favor of said Park Commission, shall exist to condemn lands outside of such area; provided, that this shall not prevent the said Park Commission from acquiring by gift or purchase, any of the General Park Area described in the preamble; provided, further, that the power of eminent domain or condemnation shall not apply to improved property on which homes are located, or to orchards located on said property, unless and until the Secretary of the Interior shall notify, in writing, the Park Commission that any such improved lands or orchards are essential to be acquired by the Park Commission for National Park purposes, and even then, until all reasonable efforts to purchase the same have been exhausted. SECTION 21. BE IT FURTHER ENACTED, That the Park Commission created by this Act, shall be substituted for the Tennessee State Park and Forestry Commission in all matters pertaining to the lands acquired by it from the Little River Lumber Company under and by virtue of Chapter 57 of Public Acts of 1925, the title of which appears in the caption and preamble of this Act, and shall have the same power and authority with respect thereto, as any other lands acquired under the provisions hereof. SECTION 22. BE IT FURTHER ENACTED, That there is vested in said Park Commission, as trustees for the State, the title to all lands not heretofore granted lying in Blount, Sevier, and Cocke Counties, and said Commission is hereby authorized to institute for and in the name of the State all actions necessary to recover the —17—
