occurring in said Commission shall be filled by the Governor. The members of said Commission shall receive no compensation for their services, but may be paid their actual traveling expenses out of any funds received by said Commission other than from the "Tennessee Great Smoky Mountains Park Fund", hereinafter provided for. SECTION 2. BE IT FURTHER ENACTED, That said Commission be vested with all the powers hereinafter set forth. SECTION 3. BE IT FURTHER ENACTED, That said Commission is authorized and empowered to receive from the Great Smoky Mountains Conservation Association, a corporation organized under the laws of the State of Tennessee, such property and monies as it may have in hand for the promotion of National Parks and the purchase of lands therefor. Said Commission, upon such transfer, is authorized to collect any unpaid balance of pledges or subscriptions made to said Great Smoky Mountains Conservation Association, and to succeed to all of its powers, and apply the funds to be received from such pledges for the purposes for which they were made. Out of such funds shall be paid the expenses of said Commission, or any judgment or judgments for damage assessed under the provisions of this Act. SECTION 4. BE IT FURTHER ENACTED, That the said Commission is authorized and empowered to acquire title in the name of the state of Tennessee to any lands contemplated by the Act of Congress approved May 22, 1926, which may be situated in the State of Tennessee, and particularly, such portions of the land as have been heretofore designated by the Secretary of the Interior; said boundaries being particularly described in the preamble to this Act. SECTION 5. BE IT FURTHER ENACTED, That for the purpose of carrying out the provisions of this Act and of enabling the said Commission to accomplish its purposes, and of enabling the State to avail itself to the fullest extent of the provisions of the aforesaid Act of Congress, and in order to provide a National Park with its —10—

Senate bill 781 was presented to the 65th General Assembly of Tennessee to establish the “Tennessee Great Smoky Mountains Park Commission" for the purpose of establishing the Great Smoky Mountains National Park. The U.S. Congress had agreed to create the park only if the states acquired the land. In 1924, North Carolina established the North Carolina Park Commission to set boundaries and purchase land. By 1931, both North Carolina and Tennessee had acquired over 100,000 acres that were deeded to the federal government and placed under the management of the Secretary of the Interior.
