Head Quarters, 4th Infantry Cherokee Agency, 3rd, Dec, 1838 (Duplicate.) To Major General Winfield Scott, [illegible] E, Division, U.S. Army. Sir: I have the honor to report that I returned to this place on the evening of the 29th ultimo with the troops, who were greatly fatigued - I shall execute your instructions for the march of the regiment as soon as possible; again there is no water, all the rivers having rapidly fallen since their recent rise. In consequence of your proceeding to the north, I address you through the Adjutant General’s office at Washington-in a sealed packet, accompanied by an urgent request that the communication be transmitted to you without delay. For fear that some of my reports to you may not have reached their destination, I transmit you herewith papers A. B.C. D. and E. these documents will make your acquainted with all my transactions in the mountains of North Carolina. In my letter to you of the 24th ultimo, I states that of the twelve surrenderers, eleven had been taken, and that of the five males three had been executed, by the Cherokees themselves, and that also one, from his youth, I had with me a prisoner; I have now to state that old charley himself, was finally captured and executed by Wa-chu-cha and Euchilla, at noon on the 25th ultimo, the day after I[illegible], [illegible]. In addition to the papers transmitted I have but little to remark, the [illegible] of the nation has been fully [illegible] for, as well as the honor of the regiment to which I belong –at, and over the graves of our murdered comrades- funeral honors were paid – for twelve days the men of the regiment passed the mountains, crossed the streams and threaded the valleys of the country, in detachment of from two to sixty men, in search of the outlaws, or as hunting parties prepared for battle or for grave. I captured no fugitives either from the camps last summer or from the parties now in [March] for the west- the thirty one Indians whom I had in my camp and

In this letter of December 3, 1838, Colonel William S. Foster details his mission to his commander Major General Winfield Scott. Colonel Foster tries to capture outlaw Cherokee Indians in the North Carolina mountains with help from law abiding Cherokee and William H. Thomas.
