  • The Astern Carolinian Voice of the Students Thursday, April 24,1980 Vol. XLV No. 29 Justices repremand administration Supreme Court declares election valid By Lee Grant News Editor Last Monday the Western Carolina Supreme Court met to hear and decide on the case filed by Jim Adams on whether or not the recent SGA presidential election was valid. The court heard arguments presented by the plaintiff's attorney, Alan Jordan along with Adams. The defense was represented by Jeff Gray. According to Adams his rights were violated when Vice-Chancellor Glenn Stiilion ordered Traffic and Security to tear down his signs due to his slogan. If you will recall, Adams' slogan was Beer, Sex, and Rock and roll. Vote Jim Adams for SGA President. Glenn Stiilion had been asked to appear in the Superior Court hearings which preceded the Supreme Court hearing. Stiilion had refused and the Courts were unable to get him to testify or state his side of the case. After opening remarks by both parties each Justice had an opportunity to cross examine both Jim Adams and Jeff Gray. After the hearing was over the Justices secured themselves in their quarter and rendered the following decision. SUPREME COURT DECISION CASE#403539 Jim Adams v. WCU Plaintiff Jim Adams petitioned the Supreme Court of SGA at WCU to hear his case on April 21,1980, in order for the Court to determine whether there was just cause to invalidate the 1980 Student Government Presidential Election on the basis that his sign was ordered down by Vice-ChanceHor Stiilion. McDaniel Traffic officer injured in accident By Lee Grant News Editor At approximately 7:45 a.m. yesterday morning Dave Bennett of Campus Security was struck by a car while directing traffic. Gail Byrd. a student here at Western, struck the officer while making a left turn. Bennett was knocked on top of the hood and carried 15 feet before he hit the pavement. The campus emergency squad reached the scene of the accident and treated the officer who was suffering from mild cuts and bruises. The officer was then taken to the hospital for a more extensive check-up where he was released later on in the day. The accident was investigated by Pritchard Smith and the State Highway Patrol. There was no evidence of speeding or premeditation in the accident so no charges were filed against the student. This was the first accident of its kind here at Western Carolina. Originally the plaintiff had appealed to the Superior Court on the basis that besides Vice-Chancellor Stiilion, U.C. Director Baxter Wood should be charged with violation of section 5[a] of the election commissions rules, but later a plea of no contest was given since Mr. Wood was found to be justified under section 9[g] of the Student Handbook concerning the University Center. This point being decided, the court was left with the Issue of whether or not the 1980 SGA Presidential Election should be invalidated on the grounds that Vice-Chancellor Glenn Stiilion and Campus Security violated section 5[a] of the election Commissions Judicial Rules which states, "No person shall remove the campaign materials, candidate materials of another candidate without the candidate's consent." While many peripheral issues were raised by the plaintiff In his case, nothing detracts from the fact that the penalty for such a violation of section 5[a] is 10 work hours per violation, not invalidation of the election. These were the grounds that the plaintiff appealed on, and the Turn to Page 18, please Outgoing executives adress Senate By Jim Wrlnn Senate Reporter "I hope we've restored the trust of the students in SGA through this very productive year," said outgoing SGA President Roger McKinney in his end of the year report to the student senate at its Monday afternoon meeting. McKinney added that he had been pleased with the year's accomplishments, and that the controversy and disrespect for SGA, which surrounded it tfcthe previous administration, had been wiped away. ?»his speech, McKinney cited eight major achieve- mrats by SGA: the first, the completion—after three }ir»rs of effort—and publication (by the Western Carolinian) of WCU's off-campus housing guide, which McKinney hopes will become an annual event; secondly, the creation of Last Minute Productions, "a more comprehensive and accountable group," from Student Government Productions and the University Center Board...of LMP, McKinney also commended Steve Fryar and Tim Jacobs for their contributions to the organization's success; "one of the least controversial" budgets passed in senate history...to this feat, the SGA leader recognized the hard work and conscious effort by the finance committee and its chairman, Dwayne McPherson; the passage of a stringent senate attendance policy—perhaps the only one of its kind in the North Carolina SGA system; "a very practical" revision of the traffic appeals procedure...in this vein, McKinney noted that for once the traffic courts had caught up on their backlog of cases, turning the judicial branch of SGA from "a weak-link to a strong part of our association"...according to McKinney, the establishment of a second court is responsible for the strengthening; the implementation of a motor pool vehicle inspection...of this, McKinney said that the senate's mandate had not yet been fulfilled because the motor pool claims the procedure would take up too many man hours—hopefully, Roger McKinney told the senate, the new SGA administration will see that this is carried out; Dead Week (the final week of classes—no teachers are to give assignments due or schedule regualr tests for that period), for which support in the faculty senate is building; and finally, the recommendation that phones be placed in the cafeterias...McKinney said that this has been done and that the administration is planning to install additional phones in all academic buildings.
