Carter gave an official explanation of why the university does not allow students to use meal cards away from school. "The university has a major foodservice program here," he said. "We believe we must have one in a location like ours while there are some off-campus options. But there's not so many that we can say 'we just won't provide a service.' Many universities over the years have tried that, even those in large cities, and it just doesn't work. We feel, and I don't foresee this changing, that we must have this [requirement]." "Our judgment has been that the fairest and best way to meet that need is to require that if you live in our residence halls r you must participate in our foodservice," Carter continued. "If you made it an option [for residents to buy meal plans], it has been the experience of many institutions that cooking in the residence halls becomes a major problem." Carter says that he knows many students use microwaves and electric coffee pots in their dorms, and the administration "can live with that." However, the university does not allow students to cook meals in the residence halls. Setting up kitchens in residence halls would not be feasible, either. "You've got terrible sanitation issues," he said." And real serious fire safety issues. Ventilation issues are there, too— everybody may not want to smell what you're making. "Having said that, the question of using the meal card off-campus involves another September 18 Officers found that an a-frame top had been broken from the building sign on the east side of the Belk Building at 6:30 a.m. A student reported that his vehicle was damaged by a hit & run vehicle while it was parked near Harrill at 9:45 a.m. A student reported that a cellular telephone was stolen from his vehicle while it was parked near Albright between 9/16 at 7:00 p.m. and 9/17 at 9:30 p.m. Officers investigated a traffic accident at Benton at 9:45 a.m. Officers responded to a request from Leatherwood to assist Housing staff with an argument between four residents at 7:10 p.m. The situation calmed and the incident was referred to Housing for action. September 19 A professor reported that a student had entered his office without authorization and tampered with computer files on 9/17. The student has admitted that he is responsible for the incident. Charges are pending. The Bookstore manager reported a missing laptop computer and related equipment at 1:30 p.m. Officers questioned a student employee of the Bookstore who admitted to the thefts. The property has been recovered and charges are pending. A student reported that a set of basketball shoes was stolen as it was delivered to Leatherwood by UPS. Officers were summoned to assist Housing staff at Albright where a female student had become intoxicated and violent at 3:00 a.m. Officers assisted in restraining the student, transported her to her residence hall, and charged her with being intoxicated and disruptive. Court date is October 15. September 20 Officers assisted a student when a vehicle rolled out of a space in the Buchanan lot and struck her vehicle at 8:45 a.m. A student reported that a class ring had been stolen from his room in Walker between 12:01 a.m. and 9:45 p.m. on 9/19. Officers arrested a male student on charges of theft of a lap top computer and printers from the Bookstore where he worked. Court date is set or October 22. All stolen property was recovered. September 21 A student reported that his car was damaged while it was parked in the lower Helder Lot between 2:00 a.m. and 1:00 p.m. Officers found some other cars in the area which may have also been damaged. At 3:10 a.m., officers observed a vehicle being operated in a reckless manner near Centennial and Central Drive and initiated pursuit on Central Drive near Albright Hall. Officers continued to pursuit to NC 1002 and back onto campus on Central Drive beside Hardee's. The vehicle continued through campus to NC 107 where Jackson County deputies took up pursuit. The vehicle wrecked on NC 116 just outside of Webster. The passenger, a 33-year-old male non-student, was pronounced dead at the scene. The driver, a 25-year-old male non-student, is in guarded condition in the medical center in Knoxville. The NC Highway Patrol is investigating the accident. Charges against the driver are pending. Alcohol was involved. September 22 Officers arrested a male non-student for trespassing and assault on a female in connection with a domestic disturbance in Helder at 4:25 p.m. The suspect, a former boyfriend, had been banned from campus after a previous assault on the same victim. Officers arrested a student for DWI and failure to stop for a flashing light at 3:20 a.m. A student reported that a break-in had occurred at his room in Benton between 9:00 p.m. and 3:00 a.m. on 9/22. September 24 Officers impounded ten vehicles for parking on campus after parking privileges were revoked. Officers confiscated a .22 caliber rifle from one of the vehicle which was impounded. The investigation is continuing. Officers assisted a resident from Buchanan in removing a small snake from her room at 6:30 p.m. Officers cited a student for underage possession of beer at 11:35 p.m. A student reported that his car was damaged by a hit & run driver at 10:14 p.m. while the car was parked in the Belk commuter lot. question. That is, are you talking about using the meal card with the student able to spend the money they paid for our food service at somebody else's restaurant?" he asked. "The answer to that is no, because the money we [the university] use to support them [Marriott] is diverted to someone else. We would have to raise our prices to offset that." Carter feels this would not be in the best interests of the students, WCU or Marriott. "If we said you could use our cards to eat off-campus, what we would be talking about is two different accounts," Carter said. "Now, the problem that presents is, what we would have is a debit card where we collect the money and it's spent somewhere else. So we [the university] would be like a banker." According to Carter, the North Carolina Attorney General heard a similar case at another state university and would not allow them to function as a "banker." In reference to the meal card article in last week's Carolinian, Carter said he was glad to see Subway open, since it gives the students more choices. Although he does not remember which restaurant chains were contacted when the food court was being planned, Carter is "fairly certain" he did not pursue Subway. "I did not want to duplicate franchises that were already in the immediate area," he said. "Because the whole idea was to add to the choices the students had... If I had put in a sub shop, it would have been a Blimpie, or a Sub Station." Rape Investigation Ongoing, Two More Reported SETH SAMS STAFF WRITER An Investigation continues in the case of a rape that was reported to have occurred on the second floor of the Benton Residence Hall on September 12. The victim in the case had filed a written request for the investigation to be terminated and stated that she would file no charges. Information was requested by acting Jackson County District Attorney Brenda Brewer. Public Safety reports that all information has been sent to her for review. Campus officials cannot enforce disciplinary actions on the allegations of sexual assault, but other actions by the two suspects violating the Student Code of Conduct are being investigated. Bill Haggard could not comment on the nature of the disciplinary action due to the student privacy act, but he remarked, "We treat any sexual assault very seriously." Gene McAbee, director of Public Safety, said of the Benton case: "I believe that our initial response to assist the victim of the incident which occurred in Benton may have also provided support to a rumor that a woman had been raped by three men behind Scott Hall on that night. That rumor has now mutated to where the woman was raped in the laundry room in Scott. This rumor is not true. Students can hear about all crimes being investigated by reading the Public Safety Reports in the Western Carolinian." Two other sexual assaults were reported during the same week. One of these occurred at Helder Hall. This investigation is complete and files have been sent to the District Attorney's office. The victim in this case did not decide to press charges, but charges were brought against the suspect for possession of a nontax paid liqueur and providing alcoholic beverages to a minor. The second case occurred at a fraternity house off-campus; the victim reported the case to the Jackson County Sheriff's Of fice. Campus Public Safety cannot investigate or prosecute in this case because it occurred off- campus and is therefore out of their jurisdiction. If the Sheriff's Office requests the campus' intervention (they have not), the Campus Public Safety will act accordingly. There has been no word as to whether or not the victim will prosecute. Asked about the nature of of most sexual assaults at Western, McAbee explained, "Sexual assault at WCU is an issue of date or acquaintance rape. "The incidents reported to us nearly always involve abuse of alcohol by both the victim and the suspect. In order to reduce the number of rapes on college campuses, men must accept their responsibility to understand and respect the wishes and desires of their dates. "Women must learn to communicate clear messages and make sure that they do not place themselves in high-risk situations," McAbee said.
