  • The Voice of the Catamounts Volume 60 Issue 18 Confusion Reigns at Committee Hearing Will WWCU be charged or won't they? Dave Williams StaffReporter A committee hearing, scheduled for January 25 at 6pm in the Catamount Room, was postponed for reasons unknown at the time. The hearing, which involved WWCU and the Rules Committee of the SGA, was to examine the alleged WWCU sexual harassment cases and the alleged illegal changing of WWCU's bylaws. So why the cancellation? It depends upon whom you ask. Kevin Westmoreland and J.B. Scires, President and Vice-President of SGA, said that they had no knowledge of the hearing. They claimed that Senator Bob Hodges did not follow proper procedures in arranging the hearing, and that he had no right to serve any subpoenas. In response to the affidavits served by Hodges, Scires replied, "They're as phony as a three dollar bill." Senator Bob Hodges offered a different view. "Assistant President Pro Tempore Rhonda Cole called up Scires to verify some of the things I discussed with the Rules Committee," he said. "Mr. Scires spoke to myself and several members on the phone in the LMP office. Then, Kevin Westmoreland came down, and we were advised that it would be in the best interests of everyone to go ahead and postpone the meeting indefinitely." "You see," Hodges continued, "the Rules Committee had a meeting at 5pm so we could go over everything we had. We had Scott Swift bringing in a fax sent by [former WWCU employee] Dawn Cook in Boston, which reiterated that she had been a witness to the sexual harassment case at WWCU. She also said that her testimony was ignored, and that she wasn't allowed to speak about it when she brought it to the attention of the Station Manager. We were just trying to establish whether or . not it was pure allegation and people from both sides were requested to attend." Scires said, "There's nothing in the SGA laws that prohibits subpoenaing a faculty member but there's nothing that gave Hodges SGA constitutional right to do this. No one can subpoena anybody under any circumstances, unless you are part of a state or federal court." Hodges maintains there were no violations or wrong doings on his behalf. "I briefed both Scires and Westmoreland ahead of time," he said. "I publicly announced before the Senate when and where the Rules Committee was going to meet, and also the nature of the meeting, so Westmoreland knew about it. The idea behind the Committee Hearings was not to interfere with the formal process of sexual harassment actions being filed with Glenn Stillion Vice Chancellor for Student Affairs. The meeting was to establish whether or not WWCU was in violation of our bylaws and Constitution." So what happens next? Kevin Westmoreland said, "We will have a meeting that will include myself, Mr. Scires, the Advisory Council, Mr. Hodges, Mr. Jacobs, and the Western Carolinian. It no one party can attend then we're going to say 'No, it has to be all or none.' We're going to get to the bottom of this and come up with some kind of solution, if any." However, Hodges has other plans: "I'm going to talk to Mr. Scires and discuss everything with him, then I'm going to file a lawsuit with the Student Supreme Court. The reason behind that is under Article 5, Section 3, Subsection 1 of the SGA Constitution. Tim Jacobs came down Wednesday night as we were about to leave, and said that the SGA had no jurisdiction whatsoever in any of this. So in order to address the jurisdiction of the SGA, I'm filing this suit against WWCU, and it will be up to the justices of the Court to interpret what our Constitution and what WWCU's Constitution says." "I mean," Hodges continued, "WWCU outright refused to come to the hearing. Mike Whalen, the station's General Manager, said he didn't have to come and that he was sending Tim Jacobs on his behalf which he can't do legally, because an advisor isn't considered an agent of anyone. Apparently, Whalen and Jacobs didn't want the facts to come out." Happy Groundhog Day! Spend it with a furry friend...
