  • SEPTEMBER 14, 1978/THE WESTERN CAROLINIAN/PAGE 7 Jimmy's still hasnk sued school by J.M.TRINKS Staff Writer It has been more than a month since torrential rains and surface runoff from the university multi-level parking lot under construction behind the Cullowhee Baptist Church apparently caused flood damage to Jimmy's Mini Market and the Cullowhee Barber Shop, but neither manager of these local businesses has yet taken legal action against WCU. In an interview Monday, William E. Scott, director of WCU's legal counsel, said the university has not yet been served with a lawsuit. "It would be pretty hard just to shell out money because somebody says 'You owe us money.' They've got to show us some evidence and all they have said is that the wall caved in," he said. He said that they have made "no allegations legally to substantiate any negligence on the part of the university, so what we do depends' upon what the attorney general's office tells us we can do." Filing deadline is Friday and the election commission will meet Friday afternoon to approve the candidates. Requirements for a senate are a 2.00 QPR (if you are not a first semester freshman) and at least 12 hours of class enrollment. First semester freshmen have no grade requirements. Scott said he has talked once to the attorney general's representative since he was here last month and he has not completed the investigation. "He's still gathering data on it now. for example, he's been up there once or twice to look the terrain over and see how the water flows and to my knowledge he has not reached a conclusion." Scoti said he is anxious to hear from the representative to see what the investigation reveals He said there "are efforts underway by the university to take all the steps necessary to protect not only university property but anybody else's property for any water that we may be responsible for." This includes negotiations now underway by the engineer's office with the contractors of the parking lot to install a large culvert to take off any drainage that might occur. Scott said if any action is filed, it could be served on C.J. Carter, Engineer Culp, the chancellor, or himself. "If I was on the other side, 1 would serve it on the chancellor's office; directly serve the university," he said. "On the other hand, it doesn't have to even come to any of us. It could go directly to the industrial commssion and they would notify us one way or the other. But up to this point we haven't been notified." Meanwhile, James A. Smith, owner of the mini market, said he has heard nothing from his lawyer or the university He said he is still hoping for an OUt-Of-COUrt settlement. Ihe grading in front of the store was for city sewage lines which he and I ebron Dills, owner of the barber shop, are paving for themselves and "in no way is it connected to the univeristv waterworks."
