Tim McNeely, charged with disrupting the Linda Rmstadt concert Oct. 28, was granted a continuance Monday night in Superior Court after two justices disqualified themselves. Chief Justice Tom Roekette, who had also intended to disqualify himself since he had worked at the concert, made the ruling. He remained on the bench because Justice Rick Desoto's absence failed to make a quorum, Justices Dan Thomas and Mike Cotchcroft also disqualified themselves be- cause they worked at the concert. In the pretrial hearing, the justices cleared the courtroom with the exception of the de- fendent, court officials, witnesses and the Western C'aro- linian, During the hearing, before court officially convened, Public Defender David Smith re- quested a dismissal ofthe case, but the attorney genera!, Jim D'lls, wanted the court to grant the continuance, "A dismissal would penalize the prosecution,** Dills told the justices. No date has been set for the trial. One student government official indicated McNeely may have grounds to appeal the upcoming judgement since Rock- ette had intended to disqualify himself but did not do so to insure a quorum, If convicted McNeely will automatically be suspended from Western Carolina University for a minimum of one quarter. After the continuance was granted, neither McNeely nor Snvth would talk about the incident or how they felt a- bout the way the trial is going. McNeely is presently on citizenship probation, according to Dills, for "destroying a bathroom door in Scott Dormitory" last spring, The WCU handbook indicates an offender must be suspended from school for a quarter if that student commits an offense while on citizenship probation. Hall visitation hours violated SGA Vice President Steve Sherman and Susan Condiinwill know within the next 10 days what price they will have to pay for lingering too long in the halls of Walker Dormitory while saying goodnight, Both entered prayers of judgement before Superior Court Monday night after being charged with violation of residence hall visitation hours, Public Defender David Smith entered the pleas —tantamount to guilty — after they were read charges that they were found Nov, 1 at 1:30 a.m. at the entrance to the elevator on the third floor of Walker Dorm. •Io Avis, residence hall director, said during testimony she saw the two at the entrance to the elevator and in- formed them they were in violation of visitation hours and escorted them to the door, Susan Condlin testified that after the couple finished watching a mo de on television about 1:15 a.m.; they started to get on the elevator when Avis came up and said she would escort them to the lobby. Tuesday after the incident, she offered to let the couple work five nights from 11:45 p.m, until 12:15 a.m. at the dorm or let the student court handle the matter, according to Condlin. The couple refused;, say. ing they thought the penalty was too stiff. After Avis offered to change the penalty to three days, the TURN TO PAGE 2 Criminal code bill considered by Allan Rabinowkz (CPS)--''There are those who say that law and order are just code words for repression and bigotry. This is dangerous nonsense. Law and order are code words for goodness and decency,..the only way to attack crime in America is the way crime attacks our people- without pity,"— President Richard Nixon, introducing the original draft of Senate Bill 1, March 14, 1973, Imagine a law that could put the New York Times editors who received the Pentagon Papers in jail for seven years but acquit virtually all the Watergate criminals because they claimed they had mistakenly thought that their illegal acts were officially authorized, I- magine that and you have captured one of the many controversial features ofthe Criminal Justice Reform Act of 1975, commonly known as SB 1. SB 1, now under consideration by the Senate Judiciary Committee under the leadership of John McClellan (d- AR), was originally intended to update and reform the US Criminal Code. Instead, the massive bill would leave the American public with a legacy of the Nixon ''Law and order" administration, Under the proposed code, the death penalty would be restored for treason, sabotage and murder under a wide variety of circumstances. The 1968 anti-riot law, which makes it a crime to cross state lines to incite a riot, would be redrafted, A "riot" could involve as few as ten people who create a "grave danger of imminently causing" damage to property. But at the same time, a person could be convicted for committing a crime that was provoked or incited by a police agent. In this case, the "incitement to riot" provision does not apply- to the police agent, The burden would be on the defendant to prove "unlawful entrapment" by that agent. Under SB 1, possession for the slightest amount of marijuana carries a sentence of 30 days and. or a Si 0,000 fine. For a second offense, the jail term All students who register early are expected to pay early during the period of November 18 - December 5, Students who have loans and scholarships are expected to complete their registration by payment of fees following registration instructions even though on aid. It is required that these students pick up their checks in Room 115, Bird Administration Build'ngandpay- jumps to six months. Under the new act, wire- TURN TO PAGE 8 their fees at the Cashier Window, The Winter Quarter class schedule will be canceled for any early registered student who has not paid his or her fees prior to 5 p.m. December 5. The late fee of Si 0.00 is effective January 5, 1976 for all students who did not complete registration including payment of fees on Januarv 2, 1976, Cats top Apps... see story p. 6

The Western Carolinian is Western Carolina University's student-run newspaper. The paper was published as the Cullowhee Yodel from 1924 to 1931 before changing its name to The Western Carolinian in 1933.
