  • 8 Western Carolinian July 13,1995 Features "Queen" continued from page 7 in their hands. The task of being a juror in a trial that seeks the death penalty is an awesome responsibility. The responsibility of jury duty is an obligation that every citizen 18 years and older might face. The expressions of the jurors in the Jackson County Justice Center showed that they were very aware of this responsibility. The judge told the jurors that the defendant did not have to prove his innocence. The burden of proof rests solely with the state, who must prove the defendant guilty beyond a reasonable doubt. The jurors then faced the first of their tribulations—a process called voir dire (to speak the truth). The attorneys for both sides question the jurors to determine their fitness to serve. Several personal questions are asked, to which the jurors are under oath to respond truthfully. The attorneys use this process to try to find impartial jurors, as well as attempting to keep jurors that they feel would be favorable to their respective sides. If a valid reason is discovered that would make it impossible for a juror to be impartial, that juror may be challenged and be dismissed. The attorneys can use what is known as a peremptory challenge to dismiss a juror for no apparent reason. Also, the judge may question jurors as she sees fit. This can be quite a trying experience for someone unfamiliar with the court system. In this particular trial, or any other in which the death penalty is sought, the voir dire is particularly stressful. The jurors are asked if they could impose the death penalty. If a juror answers "no", they will be further examined to determine their reasoning. Jurors may not be excluded simply because they do not favor the death penalty. Before they may be excused, they must state that under no circumstances would they vote to put someone to death. Some jurors in the York trial expressed opinions that they could not support the death penalty except in the most dire circumstances. Another prospective juror stated that he/she would not be able to support the death penalty under any circumstance. This juror was subjected to intense examination by the prosecutor. This is only the first hurdle that must be faced by jurors. If selected, they must endure long hours of testimony, uncertain of how long the trial will last or what effects the service may cause them personally. Meryl Streep and Clint Eastwood, both respected actors, bring their careers down a notch by trying to portray a life-changing four day love affair. The movie begins with Streep's children, possibly the two worst actors ever to hit the screen. The movie then drags on, whereas the book captivates the reader from the first page. In case you haven't experienced either novel or movie, the plot centers around a married woman's love bringing the passion and appreciation into her life which she has never received from her family. Streep looks tired and fat, while Eastwood looks more like a wrinkled prune than a gruff, sexy love savior. After reading the novel, the reader feels like they are in love, or want to be. After watching the movie, if one can stand to remain throughout the whole mess, one feels tired and angry, and sorry that they didn't stay at home. If you would like to spend money on entertainment, do yourself a favor and go to the theater, buy the affair with a traveling photographer for popcorn, then go home and read the National Geographic.
