Pasley Asst. News Editor The Student Affairs Division and the Student Government Association are working together to hold a memorial tree-planting ceremony to honor the three WCU students who passed away this year. A committee of four students is collaborating with Bob Caruso, vice-chancellor of student affairs, to plan the ceremony, which will be held on Wednesday, May 3, at 3:30pm. The students to be honored have all passed away within the past year. Alan Jerome Gibson, of Marion was a parks and recreation management major. Brandon Keith Stiwinter, from Franklin, was majoring in Natural Resources Management. Michael Anthony Stiroot, who was married and made his residence in Sylva, was majoring in biology. The students on the committee, two of whom are SGA senators, include Crystal Olson, Crystal Hughes, Jason Greene, and Roy Nation. The families of the three students will be invited and honored on this occasion. Both Caruso and Jonathan Rowe, SGA President , will speak at the ceremony, which will also include music from a clarinet quartet made up of WCU students, and a recitation of a poem. This year, Crystal Olson will be reading one of her original poems. The tree will be planted during the ceremony in the Brown Cafeteria plaza, between Brown Cafeteria and the Old Student Union, and the hole in which it will be placed has already been created. Caruso stressed that the ceremony will be as short as possible and will not be overly emotional, to preserve the feelings of the families. "It's kind of a tough event, because we don't want it to be a solemn, long, funeral- type of program," said Caruso. "They've been through that already and we don't want to reproduce that, so it's kind of a combination of a spring event with a little music and a commemoration of these students." "Someone will speak on behalf of each of the students who have passed away," said Caruso. "We've asked a friend or a roommate and we think we've got three lined up." Ramsey Shooter Sentenced by Dawn Pasley Asst. News Editor The Ramsey Center shooter, who damaged nine.windows in late December, appeared in court Tuesday, April 18, and was given probation and a fine. David Kelly, a non-student, shot out the nine windows with a high-powered rifle belonging to his roommate. He plead guilty in District Court in Sylva, and the judge sentenced him to five years probation as well as court costs and restitution, which totals more than $9,000. The case took a while to come before a judge because of some confusion about jurisdiction of the case. "There was some concern on the defense attorney's part that the district court did not have the jurisdiction to force him to pay restitution for the whole amount of the damage," said Gene McAbee, director of university police. McAbee explained that the court consisdered this case to be a civil case, and most of the time in civil cases, the defendant is usually only required to pay the insurance deductible for damaged property. This amount would have been much less than the $9,000 in damages incurred in the shooting. "In this case, there is insurance, but it's state money," said McAbee. "It's a fund that the state sets aside, so it's really taxpayer money that's paying to fix the Ramsey Center. It's not like we're paying an insurance company to provide financial protection for us." After two judges said that they believed that Kelly should be financially responsible for all the damages incurred in the shooting, the case was able to proceed. In addition to having to pay for the damages, Kelly is also banned from the WCU campus for five years. The rifle used in the shooting had previously been in state custody, but will be returned to its owner, the roommate, because it was taken by Kelly without permission. McAbee also explained an issue that came up as the case was being discussed before the trial. "Because we're not in the city limits, a person can stand across the street from campus, and fire a high-powered rifle into a building that's not occupied," said McAbee. "As long as it's not occupied, it's a misdemeanor. It's not a felony." University police had been under the impression that Kelly could be tried on felony charges for his acts, but were surprised when they were told that he could not. "We certainly believe that anybody that fires into a public building, whether it's occupied or not, should be committing a felony," said McAbee. Man Arrested for Stalking WCU Student by Daniel Menestres Staff Writer At 8pm on Monday, April 17, University Police arrested a male non-student for stalking, intimidating a state's witness, resisting arrest, and trespassing after he entered a female student's room in Scott. Police were called to the female resident's room because the male non-student had been ordered by a magistrate to stay away from her. According to University Police Chief Tom Pruett, this is not the first time that the suspect has been in trouble with the law. "He has been arrested three previous times for similar offenses with the same photo by Daniel Menestres Tennis courts are under construction adjacent to J. "Originally he was out on a $1,000 secured bond," said Pruett. After his first arrest, the judge posted a $1,000 secured bond. The next two times, the judge gave him unsecured bonds in the amount of $ 1,000 each, and was bailed out of jail. For the fourth offense, he was jailed on a $ 10,000 secured bond and remains in jail. "On April 4, the defendant was arrested for the third time for harassing phone calls after a warrant was issued the previous day. He was then given a court-appointed attorney to defend him," said Pruett. According to Pruett, the case was continued until May 16 but it has been requested that the date be moved up to May 9 to accommodate the victim, so she can testify against him. "We would ask for him to be banned from campus for the amount of time he is placed on probation," said Pruett. "Banning him from campus would apply pending the disposition of the case."
