The Voice of the Catamounts Volume 60 Issue 25 WCU Student Faces Charges of First-Degree Rape Kyle Shufelt Staff Reporter On April 12,1995, Christopher Blake Andrews, 20, a WCU student from Morganton, was arrested and charged with first degree rape of a 12- year-old girl. The alleged victim told authorities that she had participated in sexual intercourse with Andrews on the night of Friday, April 7, or the early morning hours of Saturday, April 8, in his dorm room. The incident was reported by the victim's parents on April 11, to the WCU Director of Public Safety, Gene McAbee. The alleged victim told police officials, in the presence of her parents, that the incident took place on a rug on the floor of Andrews' room, and that he used a condom. Based on these statements, a search warrant was issued for the room of the defendant on the night of April 11. According to the Inventory of Seized Property, a white pad of paper, hair and fiber tapings (a process where tape is applied to an area, such as a rug, to collect hairs, fibers, or other materials to be used as evidence), and four unused condoms were obtained. With Andrews' written consent, additional items were turned over to the authorities. These items included bedsheets and pillowcases, and a picture of the victim, which was on the back with her name, age (12 1/2), home address, and phone number. For morelnfo ^jET^jpXv An arrest warrant was then issued by the Jackson County District Court on April 12, for the apprehension of Christopher Blake Andrews. He was arrested without incident at Harrill dorm on April 12, and a secured bond was set at $50,000 by the Magistrate. Andrews had his first appearance in court on April 13. The purpose of the 96-hour hearing was to make sure that there was probable cause to hold Andrews; additionally, if he had no representation, council would be appointed him. Andrews' bail was also reduced at this hearing to a $30,000 unsecured bond, and a $20,000 secured bond. Andrews' preliminary hearing is set for May 16,1995, when he and his council will answer to the charges of first degree rape filed against him by the state. Andrews was asked how he intended to plead at his preliminary hearing. He replied, "That is something my attorney and I are still discussing." Andrews also said that his parents were very disturbed over his situation, and "my mother has taken this very hard." Andrews' attorney, Raymond Large of Sylva, said only that he was representing Andrews, making no further statements about the matter. According to Gene McAbee, campus police are handling the investigation with technical support from the SBI. McAbee stated that under the old structure of the law, phased out in October 1994, first-degree rape carried a maximum of life in prison. Under the new Structure Sentencing Act, a defendant's prior record, if any, must be taken into account when considering what the maximum sentence will be. McAbee was asked if he knew how the victim arrived on campus and if her parents were aware of her whereabouts. McAbee said that he knew the answer to these questions, but he was not able to comment because of the continuing investigation his office is conducting.
