  • (c) That adequate financial provision, including the amount appropriated hereby, has been made to purchase that part of the said area lying within the State of Tennessee designated by the Secretary of the Interior. (d) Provided, that no part of the proceeds of this bond issue herein provided for shall be used in the purchase or acquisition of land or property on which any person, firm or corporation has any right, option or privilege to cut or remove timber of any kind, size or character whatever. All land acquired with the proceeds of this bond issue shall be acquired for park purposes, and title taken in fee simple. SECTION 19. BE IT FURTHER ENACTED, That after the findings of said Commission as above set out shall have been made, and if and when the Governor and Treasurer of the State shall have also made the findings as set out in sub-sections (a), (b), (c), and (d) of Section 18 on their part, then the said bonds shall be issued as herein provided. SECTION 20. BE IT FURTHER ENACTED, That the Commission hereby appointed as an agency of the State of Tennessee, is vested with the power of eminent domain to acquire for, in behalf of, and in the name of the State of Tennessee, and to condemn, for park purposes, any lands within the area hereinbefore set out in the preamble of this Act. Provided : (1) That before any of the Tennessee Great Smoky Mountains Park Funds, herein provided for, shall be expended in the acquirement of lands for the purpose aforesaid, the title thereto shall be examined and approved by the Attorney-General of the State, or some special counsel selected by him for that purpose; (2) That before any condemnation suits are instituted, the Park Commission shall furnish to the Attorney-General of the State, the exact boundaries and location of the property sought to be condemned, and the names of all owners, or claimants, to such property, and the Attorney-General shall ascertain and determine what persons are necessary parties to such proceedings, in order to —15—
