  • Asheville NC April 8th 1868 Col Thomas Dear Sir I rec’d yours of the 4th inst by [illegible] mail and also rec’d a letter from judge Merimon the same hour, stating that you had written to him requesting a suspension of the [illegible] Ex which he says he refused, unless all your judgment creditor agreed to it in suspension, in which case he would consider it. I wrote to him that I would agree to the suspension as one of the judge! [illegible] provided the priority of my lien would not thereby be effected, and that is he judgement there was no danger [illegible] a Negroe & radical legislative would trimmed the whole thing up in a relief or stay measure amounting to (if not intended,) as a verbal reputation of the debts. You may rely that I have no objection whatever to you having the whole summer to operate as in our arrangement provided I can do without detriment or danger of entanglement [illegible] procrastination. But I so sincerely think, you have taken up a wrong idea as to the shortest and best method of bringing matters between us to a final close. I feel satisfied that delay and procrastination can only aggravate, instead of relieving the weight of trouble & responsibility attending the whole matter and particularly in relation to the bond of which I feel assured not a single day should be lost in bringing to a close up. I will write you or send you word when I receive an answer from judge Merimon who you are aware is my atty in the whole matter but I have very little belief he can or will agree to a postponement under the circumstances, unless he knew all about the judgment, against you and the action that would be pursued by the legislative which is hardly probable any man can forsee. In the mean time I hope you will use your best efforts to give a descriptive list of all the [illegible], you can to the [illegible] is time advertise duly in case a sale is thought advisable as you promised to do.
