From the Editor We finish another successful year in JCGS, one that was not without its problems and anxieties for our group, but a successful one nonetheless. From the presentation of Gary Carden's Birdell in April to the publication of the Sylva book in September, our group has been busy. We have also seemingly survived ^J another election year with its nonstop irritations and constant negativity...the price we pay for living in a republic. We wouldn't have it any other way. As always, we have many members to thank for the contents of our publication, and we trust that you will enjoy their efforts as much as we enjoy bringing them to you. One day Norman Nelon and his wife Teressa came into the office with these photographs. The picture above shows Ervin Wilkicbell Nelon and his wife Mary Elizabeth Shaw and their children. Mary Elizabeth was the daughter of Jasper and Elizabeth Dills Shaw of the Qualla community. The little boy to the right on the front row is Rufus Wilkiebell Nelon, Norman's grandfather. Dills researchers were unsure of the location of Mary Elizabeth after her 1885 marriage. Below, the stones at the resting places of the older couple, located at Cane Creek Baptist Church at Lake Lure in Rutherford County, North Carolina. We can learn a good many history lessons here if we know where to start. First, William Nulin Hemphill, the original owner of tiiis Bible, was a casualty of the Civil War. He died in prison at Camp Douglas. His wife was Nancy Angeline Monteith, daughter of William and Nancy Crawford Monteith. Their children are listed above with birth dates. After Hemphill's death, Nancy married Edmund Thompson and had several other children. By this time, this family had left the Scotts Creek section of Jackson County and had moved to the Forney section of what is now Swain County. Allen Clingman Hemphill, as did so many of his relatives, moved to Union County, Georgia. He, his family, and his mother are buried there in the Ebenezer Baptist Church Cemetery northeast of Blairsville. A couple of the names shown in the Bible are from the Forney township, and might not be any kin to this family. Also, R.A. (Roland Anderson, or "Role" Painter) was probably a friend of Hemphill's, but he was also Nancy Monteith Hemphill's first cousin. (Their mothers were sisters.) A.C. Hemphill's first wife is buried at Valley River Cemetery in Cherokee County. Nancy Angeline's siblings were S.A. Monteith and T.S. Monteith, patriarchs of most of the Swain County Monteiths, and Mary Monteith Arrington, who was married to two different men by the Arrington name, and whose family we also associate with the Forney section and with Cherokee County.] \ J KJ w » 158 Journeys Through Jackson Fall 2008 i Some U s e o f E q u i t y C o u r t M i n u t e s in G e n e a l o g i c a l R e s e a r c h [Ed. The following is the edited text of a program presented to the Jackson and Swain genealogical societies by Larry Crawford.] 01) What were Equity Courts? In North Carolina Research, Chapter 17, p.254, Raymond A. Winslow J r . explains that these courts were created by legislative act in 1806. They lasted until 1868. Other states would likely have something comparable, but I don't know what they would be called. 02) When did the courts meet? Equity courts convened at the same times as county Superior Courts, with the same personnel. One of the sitting justices would act as the judge when this type of court would be declared in session. 03) What types of cases did the courts hear? Two types of cases came before this court. The first type, which we will illustrate momentarily, was an adversarial proceeding with plaintiffs and defendants. Its concerns were debts, land ownership, or unfulfilled contracts or combinations of these. The second type of equity case was the ex parte proceeding, in which petitioners were requesting the sale of land. 04) Why are these cases valuable for genealogical research? Many of the cases dealt with heirs to estates; therefore, ALL of the heirs were named. This gives a picture of a complete family, as contrasted to wills, which might say "my three youngest sons" or some snch. Secondly, as Winslow explains, Equity Court was the ONLY court of jurisdiction for tenants-in-common, wherein some of the heirs of an estate might have moved away without disposing of their shares of land. 05) Where are these records after 1868? With the reorganization of the North Carolina court system, these cases were usually found in Special Proceedings, according to Winslow. We will look at an 1876 Jackson County case eventually. Example # l . . . "...in the year 1826, David Wilson died intestate...possessed of fifty acres...on Savannah Creek." (The defendants) "have used and appropriated to themselves all the rents and profits of the same, of the annual value of $50 dollars, and have neglected and refused to account with, and pay (to plaintiffs) any part of the rents and profits...although often requested to do so" The suit goes on to say that the land is not suitable for division, and that the defendants refuse to sell the land. The complaint asks for a subpoena of the defendants, payment to the plaintiffs, sale of the land, and "other and further relief." Who was David Wilson? What does the response say? v^ "Defendants have a separate conveyance from Richard Wilson for said land & that said Richard had had it in actual adverse possession for some twenty - four years, yet as he had no legal conveyance, therefore your Respondents do not claim to hold the same exclusively." The defendants go on to say that they are willing for the land to be sold; that there are no rents or profits or that these are of "very small value" ($10 dollars annually); and that the land had been used as pasture by Richard Wilson. They deny that had refused to sell. What can we now conclude? There is now another person to consider...a Richard Wilson as well as a David. As we do genealogy, what is the next step? Since we cannot draw any further relationships from the information given in the suit, we must go to other sources - which might be anything — to determine that Richard Wilson was the father or father — in - law of these litigants. So who, then, was David? By a process of elimination, we can conclude that David Wilson was an unmarried brother of these siblings. 160 L - C Journeys Through Jackson Fall 2008 Why did this become a problem about 1850 and not in 1828? Richard Wilson is listed in the 1850 Macon County census...in the Mortality Schedule. He had died in the previous year. He actually had possession of his son's property, but he had no legal conveyance for it. Land just to the west of East Fork of Big Savannah Creek has increased in value somewhat since 1853. Most of this land was not arable, apparently, and these folks considered it mostly worthless. Try buying fifty acres up there today. Example #2...The Hooper Suit 1853...Jackson County I published one page about this suit in the March - April 1998 issue of Journeys. Plaintiffs: Enos Hooper James Hooper William Moss and wife Elizabeth Abram Picklesimer and wife Elinor Benjamin Chastain and wife Nancy Absalom Hooper Mary Brown John Hooper and wife Margaret Milton Brown and wife Kisiah William, Andrew, Caroline, Sarah, Mary, Children of Andrew Hooper Defendants: William Hooper Isaac Hooper The suit gives the information that these are children of Absalom Hooper. Who are the actual brothers and sisters? In this adversarial suit, which is extremely bitter and acrimonious, a glaring problem emerged. I made a wrong conclusion about the John and Margaret above. This was corrected by our Society member Anne Caylor Goodwin in a 3-part article which ran in JTJva late 1998 and early 1999. Regardless of the results of this suit, which I don't know (I am not a Hooper descendant, and am interested only in helping others who might want to research this), I managed to initiate a dialogue, to put it mildly. 161 Journeys Through Jackson Fall 2008 Example #3...The Clayton Suit Henderson County, late 1850's or early 1860's John Clayton (4th great) died 1858. Ex parte suit, nothing nasty as I remember. Two of the heirs had moved to other states...Robert to Mississippi and Harriet to Missouri. Land was 230 undivided acres along the French Broad River in Henderson County. My 3rd great George Clayton sold his part to his brother - in - law J.P. Lytle, as did some of the others. The Equity suit named all of the children, giving us Harriet's married name (Becknell). We never found her after 1860 until Ruth Shuler's subscription to census services ofAncestry.com revealed her later locations. One caution: Equity courts can't stop obstinacy among researchers. Some still insist that Harriet was George Clayton's mother, rather than his sister. (His mother was Elizabeth Neill, documented in many places. I never could fight those who were always correct...! make too many mistakes.) Example #4...The Buchanan Suit This is also something I ran in the publication. This suit goes on to dispute a claim made by Ulrich Keener in Macon County, then Jackson County, in 1852 and 1853, saying that the Macon County land on Hazel Creek was not near the claim made by the plaintiffs. Then Ulrich Keener died in 1856 or 1857, thus the children named as "his only heirs at law." The children are tenants-in-common. Davis replied to the suit, calling it inaccurate, and altogettier there are some twelve handwritten pages. What drives the human spirit to explore a wilderness or a jungle or climb Mount Everest? Today we hear of all sorts of exploits such as these, and there is a tremendous amount of migration from one place to another, but many people stay within a stone's throw of their birthplace - I 'm one of those. Traveling is a wonderful pastime, but I never go anywhere that I 'm not glad to return to Jackson County. Larry and I recently took a trip and on the way we did some genealogical research on my primary interest, the William Cockerham family. What we found answered some questions but may have raised more than it answered. To give you a little background, William and his family came to Wilmot in 1824 from Surry County, some 150 miles northeast of us. In that day such a trip was undoubtedly a stressful undertaking - leaving the homeplace and the extended family to travel into a wilderness recently peopled only by Cherokee Indians. William and his sons bought property and settled in and around Wilmot and Soco. In the 1835 Congressional election, William and one son, John Burch, were found in Macon County's Deep Creek precinct while four other Cockerhams were fonnd in Haywood County's Shoal Creek precinct, actually just across the Tuckaseigee River from each other. Those four persons were Jesse, James, Daniel, and Thomas Cockerham. From that background I began to search some twenty years ago for this family. The sons John Burch and Alfred Newton were not adventurous - they stayed right here in Jackson County, and many of this Society's members are their descendants. I have previously outlined son Daniel's migration to Iowa in 1847; he went there to obtain free farm land when that territory became a state in 1846. But his adventurous spirit was preceded by his older brothers, Jesse and James. These are the two on whom we concentrated on this trip. While I don't trust data that I find on the Internet, it does give one a place to start looking for verification. I had found a family tree for one of Jesse's daughters, so I wanted to try to document it. As everyone knows, the "jumping off place" for California, Oregon, and the far northwest was St. Joseph, Missouri. The long wagon trains were formed there, and one can still see rats on the bank of the Missouri River where the wagons crossed. As I searched for Cockerham and all its various spellings, in the 1850 census I found Jesse in Buchanan County, Missouri, with wife Tennessee (Martin), and ten children, among them a William and a Charity. (Let me digress here a little: A trademark of the children of William and Charity Cockerham was the naming of grandchildren for this couple; in every child's respective family you will find these names.) It is my supposition that the spirit of adventure fell upon Jesse, and he decided to "go west, young man." While I don't have a specific departure date, his youngest child, Keziah, was born in Missouri in 1846; the child just before her, Winifred, was born in North Carolina in 1842. So they left sometime in the mid - 1840's. In the Mid-Continent Public Library in Independence, Missouri, just down the street from the Harry Truman Presidential Library, we found marriage records of some of 165 Journeys Through Jackson Fall 2008 « Jesse's children, along with other information of various kinds. Going on to St. Joseph and visiting the Buchanan County courthouse, we found deeds where Jesse purchased land in i 1847. Why did it take him so long? Was he hoping to go further west? Did he not have enough money for the longer trip? Did Tennessee decide that she had had enough of traveling and wanted a home? We don't know the reasons, but he bought acreage in Buchanan County. Sadly, we learned that Jesse died in 1851 - was it an accident? Did he become ill? Again, we don't know. Several of the daughters married during the 1850's: Sarah to John Burgess, Elizabeth Ann to John Ussary, Charity Virginia to Felix Victor Leroy Connant, Martha Jane to Joseph Pennock. By 1860 Tennessee and three daughters: Kate, Winifred, and Keziah, were in Platte County, Missouri, immediately south of Buchanan County. Tennessee then died in 1861. Of Jesse's children in Missouri, there was only one son, named of course William. I have not been able to find him at this point, neither do I have anything on Melinda and Keziah. Charity's story is an interesting one, because apparently Connant died young, and she then married a Reynolds, with whom she had a daughter. She married third to Rev. Jesse Baker, with whom she had two other daughters. Jesse Baker's grandson Charles Boulton was married to Winifred Cockerham, Charity's sister. Katherine Cockerham, known as Kate, was in St. Joseph in 1880 listed as a teacher. Jesse's oldest daughter Sarah and her husband John Burgess had three children: George, Cornelius (known as Caples), and Florence. We found where Caples was murdered in 1879 by a Burgess cousin and was buried in Camden Point Community Cemetery. We searched for a couple of hours in the hot Missouri sun, but if he has a visible gravestone, it eluded us. George and Florence were with their aunt Kate in St. Joseph in 1880, and I have traced George and his family to Chicago. I have not yet found John and »i Sarah. Jesse's daughter Elizabeth married John Ussary, and we learned that she had died in 1857, leaving three children. We found John's grave in the New Market Cemetery, along with his second wife, as well as other children. Elizabeth is probably there too, but she has no marked stone. Winifred Cockerham married Charles Boulton and had several children, but she died before 1890. This family moved to Oklahoma, then some members of the family moved on to Colorado, and it appears that some descendants are living in the Rifle area. The child of Jesse's who can be traced the best is the daughter Martha Jane, born in Haywood County in 1840. She married Joseph Pennock and they lived in Leavenworth, Kansas, directly across the Missouri River from Buchanan and Platte counties. They eventually moved to Oklahoma, and Martha Jane died there, where some of their children lived. So the spirit of adventure stayed alive in some of Jesse's family. Maybe someday I'll find William: did he go on a wagon train headed for Oregon? Was he killed by Indians along the way? Did the Kansas Jayhawkers get him during the Civil War? And what of Melinda and Keziah? Maybe they will turn up someday. That's the fun of genealogy - there's always another piece of the puzzle. G 166 Journeys Through Jackson Fall 2008 o U A n d N o w f o r J a m e s J a s p e r By L a r r y Crawford C V - Rnth has always worked on the Cockerham family, and while I've always been interested in them, I haven't concentrated any efforts in that direction. This past summer, for the first time, I actually tried to help with the research. One of the older sons of William and Charity Cockerham was named James Jasper, bora in Surry County about 1804. We would have been luckier if his name had been Roquefort or Fauntleroy. He was one of the sons who lived on the Haywood County side of the river. Later Jackson County land records indicate that his residence was on Soco Creek near the Nations and Sims families. In 1830, James J. had 1 male under 5 in his household, as well as 1 male and 1 female 20 - 30 years of age. But on the Macon County 1830 census there is a James Cockerham listed next to a John Cockerham, and they appear to be in the Deep Creek area. Possibly it is this James who presented a problem for us. How likely is it that two young men with the exact same name and of the same age group would be living fewer than ten miles from each other? A Jasper Cockerham died in 1839 - a Macon County estate record verifies that sad occurrence, and Deanne Roles brought a copy of that document to Ruth some time ago. To make it even more consistent, William Cockerham's will - probated in Jackson County in 1863 - mentions "the children of my deceased son James" and gives t h e names of Margaret, William, James, and John, "and others," and mentions that they do not reside in North Carolina. All of this fits together, does it not? Well....no. Ruth subscribes to Ancestry.com, and one of the features of that service is a census research aide. She had found, in Lauderdale County, Alabama, in 1850, a Frances Cockerham with children Jasper, Charity, Margaret, William, James, John, Elizabeth, Fanny, and Jefferson. The names certainly looked likely, but the last two children were bora in Tennessee in 1843 and 1845, so even if these were our relatives, the last two could not possibly be James's children. But not being judgmental, we decided to investigate Lauderdale County, Alabama, on our return trip. We got into Florence (in the northwest corner of Alabama) on a Monday night and went to the court house there on a Tuesday morning. In the probate office, we found marriage records and in the oldest Cockerham file, we found a sheet of paper giving power of attorney to John Cockerham (for Eliza Cockerham) regarding the "estate of William Cockerham, deceased, of Jackson County, North Carolina." This was a real thrill for us. We were able to copy some names, and we then went to the public library, where in a cemetery book we found some of those names. We proceeded to get out into the heat and find the cemetery where some of our relatives are buried. This is at a little United Methodist Church called Milner Chapel, located not far from the Tennessee line. We came home the next day, happy at our discovery, but perplexed as to why all of the living children of James Cockerham were willing to swear a lie, the lie being that Jefferson Cockerham was an heir to Jackson County William. Since Jefferson had been born in Tennessee about 1845, this was six years after James had died, and while we believe that we are related to fine, smart people, we're not sure that James was that talented. 167 Journeys Through Jackson Fall 2008 And then, the smiling face of Serendipity. What if the 1839 death of Jasper were not our James Jasper at all? Sure enough, in the Cherokee County, North Carolina 1840 census, there was a James "Cochram." The children's ages fit perfectly with what we already knew. A James voted in the 1835 congressional election from Valley River precinct. So we went to Murphy to look for Cockerhams. James is not in the land records there, but his brother Thomas is. Good grief. We aren't going to Thomas just yet. What we can conclude is that James Cockerham moved on into Tennessee from Cherokee County, North Carolina. He then died somehow, somewhere, sometime, before 1850. We can also conclude that we probably have living cousins in Northwest Alabama, because some of the graves in that cemetery had flowers. (A historical aside - cousin Luther Hine was killed in the Argonne Forest the 10th of November 1918, one day before Armistice.) For the pure genealogy of this story: William Cockerham m. Charity Jennings Their son James Jasper Cockerham (ca. 1904 - bef. 1850) m. Frances (ca. 1805 - bef. 1880) Their children: Jasper Cockerham (ca. 1827 - bef. 1860) m. 14 Jul 1851 (Lauderdale Co. AL) Martha R. Turney. He is oldest, but is not mentioned in William's will. We believe he is the father of Frances Eliza Cockerham, the beneficiary of the first legal inquiry of the Alabama Cockerhams regarding William Cockerham's Jackson County estate. Charity Cockerham (ca. 1831 - bef. 1860) is mentioned only in the 1850 census. She apparently died unmarried. Margaret Cockerham (ca. 1832 - bef. 1900) m. 15 Nov 1858 (Lauderdale Co. AL) Henry C. Hine. They had at least five children. He has a stone at the Stutts Cemetery at Milner Chapel, and we believe she is buried beside him, since there is an uninscribed stone of the same type as his. The aforementioned Luther was her grandson. William Newton Cockerham (ca. 1834 - 1 Feb 1903) died in Atkins AR. He was a Confederate veteran. (Civil War buffs will find it interesting that he had a first cousin with the same name and of the same age fighting for an Iowa regiment. Daniel Stewart Cockerham's sons fought, of course, for the Union.) John M. Cockerham (ca. 1838 - Aug 1882) m. 22 Dec 1857 (Lauderdale Co AL) Frances Jane Bryant (25 Dec 1839 - 12 Mar 1923). This brother was the one who represented his family in the legal negotiations. He and Jane had at least five children. She has a marked grave at Stutts Cemetery, he does not. James W. Cockerham (1838 - 1910) m. Martha (1839 - 1920). They have marked graves at Stutts Cemetery. We believe he was a twin to John, but that he did not have a family. His grave marker reads "Uncle Jim." Elizabeth J. Cockerham (1840 - 1915) m. 7 Sep 1883 (Lauderdale Co. AL) Thomas W. Clemmons. She is buried in Stutts Cemetery. Jefferson Cockerham (Oct 1845 - aft 1910) m. 5 Oct 1875 (Lauderdale Co. AL) Nancy Elizabeth Call (May 1855 - ). This family did not stay in Alabama. In census records they are in Pope Co. AR (1880), Red River Co. TX (1900), and Washita Co. OK (1910).
