Possibly the small child is Martha Louise Queen Kilby, who was Michael's great - grandmother. Michael has not had an easy time gathering information on Ferriby. Her second marriage was to John Queen (son of Americas) in Jackson County in 1879. In the marriage record she is shown as "Feba Leopard." Other documentation through the years shows her first married name as "Ledford." If Ferriby were indeed a Parker, was she a daughter (born in the mid - 1850's) of William and Lucinda Parker of Jackson County? The 1860 Jackson County census shows a "Debby L." Parker in that household, age 8. The 1870 Cashiers Valley census shows an ' T . L . " Parker as a sixteen - year- old in W.R. Hooper's household. Is this the same person? Was she married to a Ledford or to a Leopard? Some of this family are buried in DeHart Cemetery in Swain County, and Michael believes that Ferriby is there also. John Queen is buried there, according to his Swain County death certificate. Help, members. Occasionally genealogy can lead us into rather unsavory stories and circumstances, a fact that we must accept and learn from, if possible. The following is the work of long - time Hooper genealogist and JCGS member Naomi Hooper Green of Anchorage, Alaska. Naomi's words are in italics. Editor's notes will be appropriately marked.] / asked many Jackson County residents about this case, wanting to know whom John {Hooper} had killed Everyone agreed it was a "Parker" man, but no one could tell me his name. I talked with Eula Brown Hooper, daughter - in - law of Bragg Hooper, a younger brother of John C. Hooper. She told me much about it, but not the name of the Parker man. I finally, by process of elimination, decided it had to be Daniel Parker. Eula had told me it happened at the mustering out grounds there near the Ralph Hunter place on Caney Fork. Being told this, I was looking at the wrong timeframe. Ifinally hired a professional genealogist in Raleigh to find the case and it happened in 1857. After getting the copies from the NC Archives, my theory that it was Daniel Parker was correct. Eula Brown Hooper told me that John was only heard from once after he left NC and he was in Dora, Missouri He told them to destroy the letter. They were afraid they would forget where he was. His sister Elizabeth Hooper Long had a newborn baby, so she named it Dora Missouri Long, so they would not forget where he was. Eula Hooper wrote, "This John Hooper...was brother to Tom and Bragg. He was in the Asheville jail. The boys father, William (Hooper) had a son -in- law living in Transylvania County, who was an expert gunsmith. His name was Harvey Gillespie. He made a key and they bribed the jailer to look the other way. They had a canoe hid with provisions on the French Broad River. John escaped and went down the river and they did not hear from him for a long time." Ralph E. Hooper of Speedwell wrote that "according to stories passed down, the John Hooper as told to me by Johnnie Ruth Hooper was that he was fooling around' with another man's wife and the other man learned about this. There was a community event which included shooting matches. During this event and when guns were handy, the scorned husband confronted John of his attentions to his wife. A heated exchange of words led to John shooting the husband and fleeing. Upon capture, he was awaiting trial in Waynesville, when relatives and friends broke him out and he escaped He was heard from when he was. in Missouri, but rumor had it that he moved on to Texas where he had a family later." [Ed. Who are the principals in all of this? The victim was Daniel Parker, a son (according to Naomi) of Solomon and Elizabeth Massengale Parker. His wife was Marinda Brown, one of the daughters of John and Violet Former Brown. The accused was John Hooper, a son of William and Nancy Bryson Hooper. All of these families were well - known and recognized in the Caney Fork and Canada communities of Jackson County.] Marinda and Daniel Parker married 11 Jan 1845, Haywood County, NC. 1850 Haywood Co., NC 795/817 Parker, Daniel, 25, b. NC Parker, Marinda, 20, b. NC Parker, Sarah, 4, b. NC Parker, Levi, 1, b. NC. They lived next door to her brother, Levi Brown. I believe Marinda was living with her parents...in 1860. However, she married Alfred Fortner in Jackson Co., NC, on 23 Jan 1862. In 1870, they were in York Co., SC. 103 Journeys Through Jackson Summer 2007 [Ed. A survey of the real facts of the case leads to the following summarization: Subpoenas went out for the September 1857 term of court in Jackson County to an amazing number of persons, including Amelia Stephens, Wm. Hooper, Jr., Jas. Hooper, Jr., Harvey Gillespie, John Owen , Ellis Shelton, Amelia Shelton, Nancy Ann Shook, Lafayette Watson, Montraville Stephens, William Owens, Henry Wood, Ezekiel Brown, Nathan Coward, Edward Hooper, Susannah Stephens, Jackson Phillips, and John Brown.] [A second group of subpoenas went to Mitchel Long and Matthew Gillaspie in Henderson County and to Wm. Brown, James Wood, Daniel Phillips, Louis Queen, J.A. Moore, Mary Wood (wife of Levi), Benjamin Davis, J.Y. Low, Nathan Coward, and John Middleton, all in Jackson County.] [B.N. Queen, Justice of the Peace, heard the testimony of John R. Queen and J.S. Potts, who swore to him that John C. Hooper murdered Daniel Parker 31 Jan 1857. B.N. Queen and Jacob Wike then found Hooper guilty and committed him to the jail.] A true bill was returned in the Spring term of 1857: "The jurors for the state upon their oath present that John C. Hooper, late of the County of Jackson, laborer not having the fear of God before his eyes but being moved and ordered by the instigation of the devil on the thirty first day of January in the year of our Lord one thousand eight hundred & fifty seven with force & arms and in the county aforesaid in & upon one Daniel Parker in the peace of God & the State then & there being feloniously willfully & of his malice aforethought did make and assault, and that the said John C. Hooper a certain rifle gun of the value of one dollar then & there loaded & charged with gunpowder & one leaden bullet which said rifle gun the said John C. Hooper in both his hands then & there had & held to against and upon the said Daniel Parker then & there feloniously willfully & of his malice aforethought did shoot and discharge, and that the said John C. Hooper with the leaden bullet aforesaid out of the rifle gun aforesaid then & there by force of the gunpowder & shot sent forth as aforesaid the said Daniel Parker in & upon the left side of him the said Daniel Parker...of which said mortal wound the said Daniel Parker then & there instantly died..." [J.W. Conley was the foreman of this grand jury, which also included Benjamin Harris, W.M. Enloe, W.F. Brown, Elbert Hall, L.G. Ward, Henderson Bryson, David Hall, Daniel Bryson, Joseph Laquire, Andrew Jones, Nathan Middleton, Lewis Queen, John Messer, and A.W. Gunter]. [In the fall term of court in Jackson County, the state called William Chastain, J.L. Potts, John R. Queen, James Shelton, R.H. Stephens, Levi Brown, Thomas Brown, James Woods, Absalum Woodring, Montraville Stephens, Jackson Phillips, J.N. Cathey, William Owens, and John Brown.] [Also in the fall term, Solomon Parker testified that a fair trial was impossible in Jackson County because the numerous Hooper family members were exerting influence. Also in this term, John R. Queen testified that Hooper shot Parker, and R. H. Stephens "says that Daniel Parker come to where him and others was standing by the fire and bid all that was present, howdy, and appeared to be friendly and that John C. Hooper was standing with his gun on his sholder (sic) and says that he was not looking at Hooper at the time the gun fired but turned his head before he taken his gun out of a shooting position." GA;farm laborer Fortner, Marinda, 39, b. NC; keeping house Fortner, Nancy, 13, b. NC Fortner, Cordelia, 7, b. NC Fortner, Docy C, 5, b. NC Fortner, Cally A., female, 3, b. NC Fortner, Cinda, female, 1, b. NC He lived next door to Johnathan Fortner, age 23, b. GA. Were they brothers? Was the Nancy Fortner above really their daughter? They did not get married until 1862 and Nancy's age would have her born about 1856/1857. She was not the daughter of Marinda Brown and Daniel Parker, unless she was living with Marinda somewhere in the 1860 census. Two of Daniel Parker and Marinda Brown's children were living with their Parker grandparents in 1860 census. The other two I have not found in 1860. I found them in Florida in 1880 census. A few years ago I was contacted by Don Fortner of Florida, regarding Alfred and Marinda Fortner. He said that family tradition was that Marinda had been married before she married Alfred Fortner. They are Faulkners in the 1880 census. 1880 Lafayette Co. Florida - Page 176 A Faulkner, Alfred, 45, b. GA Faulkner, Marinda, 40, b. NC Faulkner, Dosie, female, 14, b. FL Faulkner, Cally, "female," 12, b. FL (not a female, but a male, according to Don Fortner) Faulkner, Lucinda, 10, b. FL Don Fortner says that "Caleb named his 3rd daughter Violet Hiley Fortner b. Feb. 22,1896 in Suwannee County, Florida." She was Violet Hiley Fortner and married Carl Ward 1900 Suwannee Co., Florida - Fortner, Caleb, Mar 1867,33, m. lOyrs, b. NC, father b. GA, mother b. NC Fortner, Joeannie, wife, Jun 1873, 27, m. lOyrs; 6 children, 4 living, b. FL, both parents b. FL Fortner, James A., son, Nov. 1890, 9, b. FL Fortner, Wilber O., son, Sep. 1891, 8, b. FL Fortner, Josephine, dau, Mar 1894, 6, b. FL Fortner, Violet H., dau., Feb 1896, 4, b. FL [Ed. This daughter's name is very interesting. Marinda Brown Parker Fortner had a sister named Hiley Serena Brown (m. Wilson), and we have seen the "Hiley" in another place as well, possibly in Wilkes County records pertaining to either the Brown or Fortner families, who were Wilkes County folks before moving here and to eastern Tennessee. Marinda's mother, of course, was named Violet.] 105 Journeys Through Jackson Summer 2007 [Ed. This article should clear up some of the mistakes made down through the years by persons who probably meant well, but who tended to get a few of the facts confused. There are fascinating questions left here. These include: 01) Did Hooper really escape from jail in Haywood or Buncombe County? 02) Was he assisted in this escape by his relatives? 03) Did he eventually live in Missouri or Texas? 04) Was the story about Hooper and Marinda true in the first place, or was it a legend that gave color to a killing brought about by some sort of bad blood? It is sad but true that persons will gossip, regardless of the century. It is hardly our province to judge anyone's character or behavior. 05) Is the story about Dora, Missouri true? Certainly there was a Dora Long, who, according to Naomi, married Bill Coward. Naomi sent along a family group record of the Parker - Brown family. A 1999 Internet posting from a Pam Fleming to one-time JCGS member John Siekierski led to the following summary.] Jason Elliott married Rebecca Harris in Blount County, Tennessee 10 Oct 1820. They were the parents of Malinda, Nancy Amelia, Isaac, Houston, Annie, Samuel, John, Benjamin, and James. Jason died before December 1845. In December, 1847, the two youngest sons were bound to James Brendle as apprentices until they reached the age of 21. (They were 7 and 5 at the time.) M e s s e r f a m i ly [Ed. We received a very nice letter from JCGS member Jim Hyde of Del Rio, Texas. In it he passed along that the Hyde family knowledge was that Solomon Messer's wife was Rachel Hyde. We do not have a title for a copied page sent with the letter, but we quote it as follows:] "By a second marriage the elder John Hyde produced three daughters and one son. The son, named Henry, went to Boons Lick, Missouri, where he died without marrying. The daughters were: Margaret, who married Elijah Johnson; Rachel, who married Solomon Messors and Annie, who married James Hughs." C o a l i t i o n The Society recently joined an organization called the Jackson County Arts and Heritage Coalition, becoming partners with the Jackson County Historical Association, the Webster Historical Association, Catch the Spirit of Appalachia, the Jackson County Arts Council, and others. The purpose of the group is to advocate for space in the old courthouse for the various groups. Members of the coalition spoke to the Board of Commissioners at their April meeting, and were told that anyone's occupying the old courthouse would be years away. G r a n t The Society received a nice grant from the Jackson County Community Foundation, are to use the grant to have some more cemetery books printed.
