We are late, and we apologize to the membership. Here's hoping that all of the genealogy herein wUl make up for our tardiness. We have a little of everything this time. For those who like the pure genealogy found in these pages, you can find much of it with Betty Cope Andrews and Betty Queen Monteith and their descendancies of Gribble and Wild, respectively. If official records are your cup of tea, then the usual death certificates, census work, and this issue's "Hog thievery" will be rewarding for you. We also have a narrative, and we publish some very fine old photographs this time. Follow all that with Civil War letters and the first installment of one of the important Macon County cemeteries, and you have an eclectic issue with something for everybody. Ms. Brown sent these to the Society some years ago, and said that her grandfather John Boone Brown made some of the photographs. Her father, John Julian Brown, had provided information about the pictures. All of these were labeled "Cullowhee Copper Mine," a locality that had been a topic of conversation recently at the Society office. Some old criminal actions strike us today as humorous, some are as horrifying as modern headlines, all are interesting reading. Most of the persons involved in these actions have ties to today's Jackson County. Transcribed by JCGS member Ruth Shuler in the North Carolina State Archives 9 May 2006.] North Carolina, Macon County: Court of Pleas and Quarter Sessions, June Session 1839 The jurors for the state upon their oath present that Jane Collins on the tenth day of June in the year of our Lord one thousand eight hundred and thirty-nine With force and arms in said County of Macon then and there did sell and retail spirituous Liquors by the small measure, to wit, by a measure less than a quart, without then and there having a license to do so, contrary to the form of the statute in that case made and provided and against the peace and dignity of the state. F. Axley, Sol. State vs. Robt. Ensley: Superior Court of Law, Fall Term A.D. 1839 Robt Ensley, The Defendant swears that at the term when the forfeiture was taken against him he was sick in the Cherokee Nation & unable to attend the Court, he remaining sick for some time afterwards unable to attend to any business whatever. Isl Robt (x) Ensley Sworn to and subscribed 26 Sep 1839, S.M. Powell, Clk. January 1842 Calvin Parker, on the 24th of Jan 1842, "did fellowneusly take, steal, & carry away one hog of the male land" belonging to John Stilwell, value six pence January Session 1843 To any lawful officer to execute & return: Whereas personally appeared before me Alfred Hester an acting Justice of the Peace in and for said county J o a b L. Moore & maketh oath that he has good reasons to believe & does believe that one Jackson Cogdell & Jackson Gunter late of Macon County did some' time in August last feloniously steal & take away from the mountains of said County three horses; viz, one sorrel horse & one bay mare & colt the property of the said Joab L. Moore in violation of the laws & against the peace & dignity of the State. These are therefore to command you to arrest the bodies of the said Jackson Cogdell & Jackson Gunter & have them before some justice of the peace for said county to be further dealt with as the law directs. He is therefore committed until he enter into a recognizance in the sum of one thousand dollars. Isl A Hester 1845 This day appeared Wm. B. Queen before me James McKinny one of the Justices of the Peace for sd county and after being duly sworn saith on his oath that Jonathan Zachary did with force and arms take possession of his gold mine and without his leave contrary to law and against the peas and dignity of the State. Sworn to and subscribed before me May 30,1845 Isl Wm. B. Queen: test James McKenny JP To the Sheriff of Macon County or any of his Law Debites: You are hereby commanded to take the body of Jonathan Zachary if to be found in your county and safely keep and cause him to appear on Saturday 7th of June next at James Brown's store before one or more Justices of the Peace for said county. To answer the complaint of the State and to be tried by jury of twelve good and lawful men according to law and him not discharge until the Justus or justices discharge him according to law. Isl James McKenny, JP Macon County, North Carolina: Jun 7 1845 The State vs. Jonathan Zachary The jury called sworn and impaneled, to wit, Barack Norton, Alexander (sic), Mark Burel, Sidny Hamshaw (?), Alford Wilson, Thomson Wilson, John Teague, Alen Barens, John Bagwell, Magnus Teague, and Elias Norton. The above jurors verdict in favour of the defendant Isl James McKenny, JP North Carolina, Macon County: Superior Court of Law Spring Term 1847 State vs. David and Meriman HaU William Stalcup swears that he placed in the hands of Ezekiel Dowdle Sheriff of Macon County a bench warrant issued by Your Honor for the arrest of said David & Merriman HaU for the crime of murder. On Saturday about 12 oclk on the day at the home of Nimrod Jarrett, 19 miles distant from this place, and requesting him to arrest the prisoners immediately. That said Halls reside some seventeen miles distant from this place, and as this affiant is informed and believes that the said prisoners were in this county at the time the Sheriff received the (torn) and have remained here ever since except the said David has left in a day or two. That the Sheriff has not arrested the said David, nor has he used the necessary exertions to arrest him. And this affiant is informed and believes that the Sheriff could have arrested him if he had undertaken to do so. The Sheriff informs this affiant at the time he received the warrant that he could not arrest the prisoners and if he did he KJ 106 L Journeys Through Jackson Summer 2006 could not put them in jail before they had trial and commitment /s/Wm. Stallcup, attest D R Lowry, Clk North Carolina, Macon County: Superior Court Spring Term 1847 Noah H. Palmer maketh oath that he was deputed by E. Dowdle High Sheriff of sd county on Tuesday last, some time about the middle of the afternoon. Sometime during the conversation between this Affiant & sd Sheriff this affiant suggested to sd Dowdle if it would not be prudent to take someone with him. Dowdle then said perhaps it would be prudent to take some . Dowdle had said nothing relative to taking until it was suggested by this Affiant. Then Dowdle then carelessly observed that William Roberson was not doing anything here & perhaps he might as well take him along with him. Then he told the Affiant to go & stay aU night at WiUiam Tatham who lives some eleven miles from this village and to take Tatham with him next morning to arrest one of the Defendants Halls who he supposed lives about one mile & a half from Tathams, to arrest him & leave as prisoner in the custody of one John Wilson & a man by the name of Cabe, Wilson's soninlaw, and then go on with Tatham and sd Roberson & arrest the other accused. This Affiant further maketh oath that he did proceed to the house of Joshua HaU where he found David HaU, one of the accused, who was armed & refused to be taken & this affiant having no second except a nor his guard having arm save a small pocket pistol could not take sd Hall. HaU then came up the road this direction some three miles where he was seen by sd Affiant again & was sull threatening that He would not be taken which was only some fourteen miles from town. This Affiant further maketh oath that sd. High Sheriff did not apprise him of the importance of the process'which he handed him nor did he tell this Affiant to summon a strong armed guard and take the accused at all hazards. If sd Sheriff had so apprised this Affiant he would have summoned a guard strong enough and would have taken sd defendant dead or alive. But being wholly unapprised of the high dignity of the process which sd Sheriff had furnished him he did not make such preparations as were absolutely necessary to arrest sd defendant without running the risks of great bodily harm and perhaps loss of life. This Affiant further states that he returned to this village on Monday evening and informed sd Dowdle what had taken place. Dowdle then took back the process and said nothing more to this Affiant This Affiant states that he left sd David Hall only some fourteen miles from this village. Dowdle when this affiant handed him back the paper said that he would go down and see the States Solicitor & see ehat he would say abont further operations. /s/N.H. Palmer; Sworn to D.M. Lowry, Clk. North Carolina, Cherokee County: To the Sheriff of Macon County, Greetings. Whereas information has been made to me upon oath that David Hall and Merriman HaU of the county of Macon are guilty of the crime of Murder and take the life of one Seth Stalcup in said County. You are therefore hereby commanded to arrest the bodies of the said David HaU and Merrimon Hall and then safely keep so that you can have them before the Judge of the Superior Court of Law to be held for Macon County on the 3rd Monday of 'March instant at the Court House in Franklin. Then and there to answer the above charge of Murder and to be delt with as the Law directs. Dowdle, Shff. \J North Carolina, Macon County: Superior Court of Law, Spring term 1847 To the Honorable the Judge of Said Court: E Dowdle, Sheriff of said county, who has been served with a rule to show cause why he shall not be attach a contempt of this Honorable Court for faiUng to execute a warrant placed in his hands for the arrest of David Hall and Merriman Hall, charged with Murder, answers: That a warrant which is herewith returned was handed to him on Saturday last about 12 oclock in the day 19 miles from this place and that the defendants named herein lives in this County some 16 or 17 miles from this place in the opposite direction from where he received said warrant Respondent reached Franklin on that evening about 7 oclock (having been detained by high waters several days longer at Murphy than he expected) and having a great deal of official business to do before the sitting of this Court, he believed that it was impossible for him then to undertake to execute said warrant in person without neglecting other important official duties necessary to be done before the sitting of this court: And furthermore he believed that he could not execute the same & return in time to be in attendance on this honorable Court. But respondent avers that he diligently endeavored to procure a deputy to execute said warrant which he did on Sunday & this deputy left immediately for the purpose of arresting the defendants, but he returned without having done do. Since the return of his deputy on Monday evening l a s t respondent has been in attendance on this Court & could not have left to execute said warrant without neglecting what he understood to be his duty - to be present during the sitting of the Court & besides he has been advised by Counsel & beUeves that he had no legal power to arrest by virtue of said warrant after the day mentioned therein. On Tuesday last one of the \^_j defendants (Merriman HaU) named in said warrant came to this village and was arrested by respondent & committed to the common jail of this county and is now held in custody by virtue of another warrant subsequently issued by your honor and that since the issue of the last warrant he has empowered another deputy to arrest the defendant David, but whether he is still in this county respondent is not positively informed. Respondent denies that he intended to disobey the process of this honorable court or delay in executing A, but avers that he has used aU the means at his command to execute said warrant. Respondent on yesterday ceased to act under said warrant as he was advised by counsel that all the power which it may have to respondent had ceased, & further that it was void for want of a seal. Without diminishing the seriousness of the case, and without questioning the veracity of the statements of anyone involved, the facts are that both Micajah Merriman and David Hall would rear families and live for years after this accusation. Persons might find it interesting that the John WUson mentioned above was David Hall's father-in-law (David Hall m. We revisit this list after a long, long absence. To refresh the memories of our members, the state constitutional amendment requiring permanent voter registration was a barely - disguised piece of racism. If a person's grandfather had voted in the 1860's, then the person could register to vote. This conveniently excluded almost all black persons from having the right to cast a ballot. The silver lining for genealogists here is that one can sometimes determine the parentage of a man by studying these lists. The two of them, along with their brother William, served in the same company. When he speaks of the 16th, he is doubtless referring to Company A of the 16th North Carolina. Laura married Rufus Henson, Wilson married a Watson and lived in Andrews, John married Rebecca Phillips, Samuel W. married Mary Hoyle and is buried in Shuler Cemetery where his parents rest, Andrew married Rosetta Mills and lived in South Carolina, Sarah was not married, and "Rick" married Novella and is buried at Red Bank. This is the editor's own work.] One of the axioms of genealogy is that one answer tends to create many new questions. Some of these questions can be teasers for years, until just the right set of circumstances can lead one to a new conclusion or so. As novice genealogists, before the days when computers and copying machines were everywhere, we had made a list of all the Crawford brides and grooms found in the Haywood and Jackson marriage records. Then we patiently zeroed in on each individual, trying to place him or her in the correct family. That was not always the easiest task, since the Haywood County Crawfords and the Jackson County Crawfords are not related, at least back to the mid-eighteenth century. The Haywood Crawfords descend from a Washington Crawford and his wife Sarah, the Jackson ones descend from a Samuel. The Macon County Crawfords are related to the Haywood ones, the Cherokee County ones to the Jackson County ones. And both groups had family members to move to north Georgia. One bride who was listed in Jackson County's records was especially difficult...a Martha Crawford- who married a Montraville Bennett 3 Apr 1866. Except for occasionally running across mat name, Mrs. Bennett was always on the back burner. Then in May of 2006, we were at the North Carolina State Archives looking for materials to be published in Journeys Through Jackson. One document we found there was the (Civil War) Widow's Application for Pension for an M.J. Crawford, widow of Samuel E. Crawford. On May 27,2006, we asked Bill Crawford who these folks were, and the fun began. The M.J. Crawford who applied for the pension lived at Speedwell in Jackson County, and stated that she was age 66-in 1910 when the application was made. She gave her late husband's regiment and company as the 62nd North Carolina, Company G. In the North Carolina Troops series, in the appropriate place, we find a Samuel E. Crawford, but the information given says only that "pension records indicate that he was a member of this company." This is no help for us, but listed right above him was a Samuel C. Crawford, who enlisted at the right time, was captured at Cumberland Gap, and died at Camp Douglas. Is this the right man? We believe so. When Montraville Bennett married Martha Crawford, she had three small children. The two older children were Adaline, born about 1859, and Sarah, born about 1862. The third was a son named Samuel, born about 1863. How did we arrive at these approximate birth dates? By using the federal census for 1870 and 1880. The 1870 census is especially helpful in this case, because under Bennett's name in the Cullowhee township, Martha is listed as "Martha Crawford," followed by her three children. How unusual is this? She had been married to Bennett for four years at the time, so she had no legal reason to still use the "Crawford." Even better, why did she not use her second married name in 1910 when she applied for the pension? We may never know the answers to these questions, but we are grateful that she still used the "Crawford." In 1880, this family is still intact in the Cullowhee township. This time the "Crawford" surname is not used at all, even with the three children who should have that name. Samuel is listed first, and is shown as age 17, for some reason appearing before Sarah, who was age 18. Adaline is shown last as age 21, even after young Bennett children, because she had two small children of her own at the time. 143 Journeys Through Jackson Summer 2006 In the Jackson County marriage records, S.N. Crawford married 8 Mar 1891 to a young woman called D.M. Adams. "Sam" Crawford had witnessed his sister Sarah's marriage to ^_y Sidney Holland 30 Sep 1883 at M. Bennett's house. Later, S.N. Crawford, age 35, had married Jane Webb, age 19, in January of 1900 in Macon County. Martha is shown in two different sources with the surname of Kirby. We checked the cemetery book to see if the Bennetts are buried in Jackson County. Yep. Hooper-Speedwell Cemetery. Go to the proper page. No dates. Doggone. But the Bennetts were still living in the Cullowhee township when the 1920 census was taken, and Martha has a death certificate from 1921. Since we have found the son Samuel Crawford, we decided to concentrate first on him. He and Jane Webb were the parents of eight children, including AUie Fair Crawford Haskett, whose daughter Othella married Bill's brother Frank. (Mrs. Haskett was also the mother of several other well-known persons in the Sylva community.) This family had always indicated to Bill that their Crawfords were Macon County Crawfords. They would therefore be kin to the Haywood County ones, rather than the Jackson County ones. The only problem with this is that in the 1850 census, no family in either county had a Samuel born about 1838. (This approximate birth year comes from the Jackson County census of 1860, where Sam'l and M.J. are enumerated.) Next step: commission good friend and JCGS member Betty Painter Foti to ask Mrs. Freda Queen and Mrs. Hazel Monteith, daughters of Mrs. Haskett, where their Crawford grandparents are buried. This resulted in an answer of Holly Springs in Macon County. Forward to May 30 and a trip to Macon County. After finding the proper grave stone at Holly Springs, we learned that Samuel N. Crawford was born 6 Mar 1863 and died 3 Sep 1938. His wife, Nancy Jane Webb Crawford, was born 24 Jun 1878 and died 15 Feb 1959. Next, we went to the Macon County Register of Deeds Office to find a death certificate for Samuel. Not only were we successful here, but we found a very interesting document indeed. It states that Samuel Newton Crawford was born at Speedwell, N.C., the son of Samuel Crawford and Martha Fox. The father Samuel shown here was listed as being born in Alabama. This statement, on the part of Informant Luther Crawford of Highlands, is slightly inconsistent with the 1860 census that shows Samuel as bom in North Carolina. The Martha Fox is intriguing also. Since we have what we believe to be reliable sources for a maiden name of "Kirby," we believe that possibly her mother was the Fox. So what would be our next step? We went to the Macon County Library to check old issues of the Franklin newspaper for obituaries. In the issue for 8 Sep 1938, S.N. Crawford's death is on the front page, and names his widow and eight children surviving him. Those children were Lee, Willie, Luther, George, and James Crawford, Alifair Haskett, Cordelia Cabe, and Bertha Holland. Two sisters, Addie Mason and Sarah Holland, also survived Samuel. Jane Webb Crawford's obituary, more than twenty years later, added details like her death at her daughter's, Mrs. Jack Cabe's, in Holly Springs community. Also listed as surviving are Mrs. Haskett and the five sons. Those sons are Rev. Lee of Franklin, Willie of Cullowhee, James of Highlands, and Luther and George of Apopka, Florida. The marriage certificate for Samuel and Jane was also available. S.N. Crawford applied for a license 19 Jan 1900, stating that he was from Jackson County, age 35 (he was actually 36), and was the son of Samuel Crawford and M.J. Crawford, the father dead, the mother living in Jackson County. A.C. Queen performed the marriage 28 Jan 1900 in Mill Shoal Township. 144 V J \J L-L L Journeys Through Jackson Summer 2006 We can bring many parts of this family forward, but we still have not made a serious attempt to identify the Samuel Crawford who-was the father of Samuel Newton Crawford. We need to review what we believe to be true: we believe he was dead before 1870, and we believe him to be the Samuel Crawford who died at Camp Douglas. The next logical step would be the 1850 census. Enter Ruth Shuler and the Ancestry.com census records. A Samuel Crawford is shown in Gilmer County, Georgia, 15 years of age in 1850. No father is shown, but he is in the house with Elizabeth Crawford and some other children. Not only do we believe this to be the cdrrect Samuel Crawford, we also believe that this was the widow of Francis Crawford, who married Elizabeth Land in Haywood County in 1834. Elizabeth and some of her children lived in Jackson County in 1860, but the family was in Gilmer in 1850. They lived next door to a Land family. We believe that this- is the same family whose daughter Lucinda married Jackson Mathis in 1855 and whose daughter Melinda married Hugh Mathis in 1863. Certainly the Speedwell - Wilson Creek area had plenty of folks with that last name, so did Samuel E. Crawford marry a neighbor when he married Martha Kirby? Who was Samuel genealogically? We believe him to be the oldest son of Francis Crawford, who we believe in turn to be the youngest son of Samuel and Mary Briscoe Crawford and possibly a twin to Frankie Crawford who married Oliver Painter. The 1840 census shows Francis as head of household with two small sons and one small daughter. We realize that many of these statements are not proved to be factual, but perhaps they will be a starting point for someone who descends from this family. Somewhere out there is a piece of paper... Samuel Newton Crawford's oldest sister Adaline married James Mason in Macon County 17 Nov 1887. As we have already seen, she outlived-Samuel. In the 1900 census, she is shown as the mother of five children, all living, with sons Sam (age 10), and Lee R.-(age 4). There is also a daughter named Letha, age 7 in 1900. In 1880, Adaline had two-small children, a James C, age 5, and a Callie A., age 1 month. Samuel Newton Crawford's next older sister lived in the Sugar Fork township of Macon County in 1900, and was the mother of nine children, daughters Ivalee, Allafair, Cordelia, Charlotte, and Elizabeth, along with sons Tillman, Talmadge, Spurgeon, and Willie. Sarah does not appear to have a Macon Count6y death certificate. Returning to the original family, the 1850 census for Gilmer County, Georgia reveals a young mother Elizabeth, age 26, born in North Carolina. This age is in error, because Elizabeth married Francis Crawford in 1834. We believe that the census enumerator copied a numeral incorrectly, and Elizabeth should have been shown as age 36. With her are sons Samuel (age 15), John (age 13), William (age 6), and Amanuel (age 4). Also listed are daughters Lucinda (age 11) and Melinda (age 9). Lucinda married Jackson Mathis 31 Jan 1855. No specific place is given for the marriage, but it was performed in Jackson County by J. Wike, J.P. We have not found Lucinda and Jackson in 1860, but in 1870 they are in Towns County, Georgia, where, interestingly, he is called "Matthias Jackson" in the census. He is shown as age 41, a farm laborer born in North Carolina. Lucinda is 30, also born in North Carolina. They have children Violet C. (age 12, b. NC), John D. (age 8, b. NC), Samuel T. (age 6, b. NC), Martha A. (age 4, b. TN), and Peter F. (age 3/12, b. GA). Her mother is here too, but more on that later. We would consider it very interesting if this little boy born in 1870 were named "Peter Francis." If so, we believe he would be named for both grandfathers. By 1880, this family is in Jackson County again, in the Cashiers Valley Township, where Andrew J. Mathis is shown as age 58, mining. Lucinda is shown as age 46, and the children shown are John D. (age 18), Samuel T. 145 Journeys Through Jackson Summer 2006 (age 16), Alice M. (age 13), Lizzie L. (age 8), Andrew G. (age 5), William P. (age 9/12, b. Sep.), followed by daughter Violet C. Tilley (age 23) and her children David M. (age 4) and Panda (age VJ 2), both born in Georgia. By 1900, this family is enumerated in Fannin County, Georgia, where Andrew J. Mathis is shown as age 67, born Jan. 1833 in NC. Lucinda is shown as age 62, born Dec. 1837, and the children listed here (among 8 of 10 living) are John D. (age 38), Andrew G. (age 23), William P. (age 20), and James H. (age 16). Melinda Crawford married Hugh Mathis 10 Oct 1863. This marriage was performed by Wm. Wilson, J.P. In 1870 in Towns County, Georgia, we find Hugh Matthews, age 27, Melinda, age 26, and children James A., age 6 b. TN., Sarah A., age 4 b. TN. And William N., age 1, b. GA. It is possible that Melinda was widowed by 1880, for there is a Melinda Matthews in Fannin County living in the house with her mother "Emily" Crawford, age 60. The children shown here are James, age 14, b. TN., Sarah A., age 13, b. TN., Millie, age 10, b. NC, and Darcy or Nancy, age 8, b. GA. This may well be the same Melinda. Back to Elizabeth in 1860. She lived in Jackson County where she is shown as age 45, with children M. (female, age 15), Wm. Age 14, A. (male, age 12) and H. (age 8, male). We had stated earlier that Elizabeth was with Lucinda in 1870, where she is shown as age 60 and "retired" from keeping house. Andrew H. was also listed here at age 17. Elizabeth had, if our speculation is correct, lost her son Samuel to the war, and she might also have lost John and William to the same conflict. Amanuel would have been too young to go to the Civil War, but we have not as yet found him after 1860. We would hope that some descendant in this family would take this information and run with it. There would be many sources in the state of Georgia to research, and much work needs to be done. We are confident that Sam Crawford was the oldest son of Francis Crawford and Elizabeth Land. We also believe that he died at Camp Douglas, and that his widow Martha Kirby Crawford married Montraville Bennett in 1866. Their children are easy enough to enumerate and find.
