By the time you receive this issue of Journeys, both May and June will be over. The end of a school year is always a busy time, but excuses are not in order. Notice the outstanding announcement on the first page this time. All of you (and everyone else you know with Jackson County connections) will want to become involved in this new project of the Society. The first book was such a success that we have sold out three times, and we currently have a waiting list for still another printing. In this issue, read the conclusion of Shawna Hall's compilation of her Owen relatives, see the primary - source documents relating to the Civil War and to the 1880 residents of Savannah, and as usual, enjoy the regular articles that find their way into these pages. We hope the pictures print well. All of them this time focus on the community of Dillsboro. Finally, make sure to submit your Holden Award nomination this year. The award will be presented at the August meeting, the picnic to be held at the WCU picnic area this year on August 12. Are you ready to work?] In response to demand from local residents, as well as-people with ties to Jackson County, plans to print Volume II of Jackson County Heritage are moving forward under the sponsorship of the Jackson County Genealogical Society. Ruth Shuler was elected coordinator of the Book Committee, and David Frizzell will serve as treasurer. Dorris Beck and Helen Vance will be co-chairs of the Family History Committee. Other committee chairs include Sharon Carnes, topics; Larry Crawford, memorial pages; and Roy Shuler, publicity. The Book Committee also includes Rachel Phillips, Peggy Mason, Bill Crawford, Helen Cooper, Mack Sutton, Mary Moody, Lloyd Cowan, Rick Frizzell, Betty Foti, Irene Hooper, Michael Clark, and Marie Treadway.. Work has already begun on the new Jackson County book, which will be published in late 2000. Each family with connections to Jackson County is invited to submit an article and one picture to ht published in the book free of charge. Those interested in being included in the book are asked to write the Heritage Book Committee at P.O. Box 2108, Cullowhee, NC 28723, for a brochure outlining specific directions for submitting articles and pictures. The above photo of the Old Mill Inn was taken from a postcard. Anyone identify the make and model of the car? One can see the George Pangle house nearest the Scotts Creek bridge, also the C.J. Harris house (now the Riverwood shops), and the Jack Messer house across the river. The ford was up the river at Cabe Hill. The road has tram tracks, used to transport clay from the Hog Rock clay mines. « - 72 i*Sft? Journeys Through Jackson. The building at the top right was an all-black school, the white church visible along the main street was Presbyterian in affiliation, the pin mill is across the street from the church. One can see a train along the tracks here. The Leatherwood store is visible (are some of these buildings still standing today ?) and the white building at the lower left was the jail. At the upper left, the two-story building was a Masonic temple. The editor is sure of only one identification. The small boy in the second row, white shirt and suspenders, about eighth from the right, is Elbert Carnes, who passed away this year. He has a son and two grandsons who are members of JCGS, and bis son Cance verified the identification. The family resemblance is very evident here, and those hundreds of people who are privileged to know the "Ebb" Carnes family will enjoy seeing this likeness. Question for the more knowledgeable: is this photograph taken at the old Masonic Temple where classes were held? Cline, R.J. Bryson, Edward Chastain, J.W. Shelton, Jeremiah Jinkens, and Sylvanus Brooks, Privates of Company K, 3911, Regiment, North Carolina Troops, late Capt. A.W. Coleman's Co. A, 16th Regt. NC Troops, enlisted and mustered into service by Col. J.P. Cuningham at Webster, Jackson Co. NC on 27 day of April 1861, and afterwards enlisted for two years under Act of Congress 11th December 1861, & afterwards reorganized as Company A, 16th Regt NC Troops at or near Yorktown Virginia on 25th day of April 1862, authorize constitute & appoint, and by these presents authorize constitute & appoint Lieut. Col. James R. Love Thomas Legion & formerly our Captain, our true and lawful Attorney or Agent to receive and receipt for in our names and stead with any person or persons authorized to pay the state bounty of North Carolina for the bounty due each of us from the state of North Carolina, being in each of our cases forty dollars, having each of us received from the state of North Carolina ten ($10) dollars. We each of us further authorize our said Attorney or Agent to substitute any one he may deem proper in bis place to receive and receipt for said Bounty from the state of North Carolina, he our said Attorney or Agent Lieut. Col. J. R. Love has advanced in each of our cases forty dollars, the bounty due each of us from the state of North Carolina, and it is the wish of each of us that our said Attorney or Agent should receive all the benefits that may arise from said bounty due each of us from the state of North Carolina, we each of us do by these presents for ourselves, our heirs and administrators & executors sign over and relinquish all claim or title to said bounty to our said Attorney or Agent, we each of us hereby ratifying and approving and confirming all acts our said Attorney or Agent may do to get said bounty from the state of North Carolina. Journeys Through Jackson May - June 1999 N o r t h C a r o l i n a L a n d G r a n t s [The following is copied from a handout given to Society members at the October 1997 meeting. Its information might be "old" to those of us who were in attendance at that meeting, but it is actually timeless. ] Introduction to Land Grant Records HANDOUT / 1. A land grant is a transfer of ownership of land from a sovereign power to a private citizen. Although the terms land grant and land patent are used interchangeably, patent is the technical term for the actual document and the act of transferring ownership of the land is a g r a n t of patent. 2. Land grants or patents were of three kinds: purchase patents in which case the patentee bought the land outright. headlight patents where a settler obtained a given quantity of land simply by moving into the colony or paying for the importation of other settlers in the colony. military patents in which the patentee received land for military service. 3. The-steps in obtaining a land grant are: entry - the first application on the part of the settler that a piece of land be granted to him. This application originally was made to the secretary of the colony; later to a county official known as an entry taker. w a r r a n t - the legal authorization to the surveyor to g o out and survey the land described in the entry. survey and plat - a plat is a small map of the land to be granted drawn by the surveyor after he had surveyed the land. When the plat was drawn and the description of the metes and bounds of the land written on the back by the surveyor, copies of it and the original warrant were returned to the secretary. t grant of p a t e n t issued - upon receipt of the plat of survey, the secretary drew up a large legal form called a grant of patent and attached a copy of the plat to it. The governor then signed the grant and the secretary fixed the seal on it. The grant was then copied into one of the land grant books. When all the fees had been paid, the grant was delivered to the new owner. 4. History of the Land Grant Office: Proprietary Land Grants - in 1663 and 1665, Charles II granted to eight men who helped him regain the English throne, an enormous expanse of land in America in which was located present-day North Carolina. Under the two charters, these eight lords proprietors received the authority t o grant land. These grants from 1663 to 1729 were almost always in the form of headlights. 89 Journeys Through Jackson May-June 1999 Crown Grants - George II bought Carolina back from the proprietors in 1729. From 1729 to 1744, Crown grants were issued for land in any place in the colony. From 1744 to 1775, the royal authorities issued grants for land only in the southern part o f North Carolina. The Crown land office closed in 1775, and there are no crown grants after that date. The Crown continued the headlight system used by the proprietors until about 1752. After that date, purchase patents were the usual form. » Granville Grants - at the time the Crown bought Carolina, back in 1729, the descendant of one of the original proprietors refused to sell his share. He was John Carteret, second Earl Granville. Lord Granville owned the northern part of North Carolina above a line which ran along the southern boundaries of present-day Tyrrell, Chatham, Randolph, and Rowan counties from the ocean to the mountains. Lord Granville opened a land office where grants were issued from 1748 to 1763. Headlight patents were never issued in the Granville District. Lord Granville's agents sold land outright in the form of purchase patents to anyone with ready money. Granville died in 1763 and his land office never reopened. State Grants - the state of North Carolina assumed title to all vacant lands in the state during the Revolutionary War. Land offices were opened in every county, both in the old Crown District and in the Granville District. The state granted purchase patents outright to anyone having ready money. The state of North Carolina ceased granting land in 1959. Tennessee Grants - what is now the state of Tennessee was a part of North Carolina until 1790. This state made grants there from 1778 to 1790 just as it did in any other part o f North Carolina. Records of all grants prior to 1790 for land in what is now Tennessee are among the North Carolina land grant records house in the State Archives. Military Grants - in order to recruit soldiers for the regular army during the Revolutionary War, North Carolina promised free land in what is now Tennessee to anyone who would sign up. Militia soldiers did not receive land - only those soldiers in the Continental Line. Military grants were all for land in what was then Sumner and Davidson counties in Tennessee. 5. Land grant records are now housed in the North Carolina State Archives, 109 East Jones Street, Raleigh, North Carolina 27601-2807.
