THE SECRETARY OF THE INTERIOR WASHINGTON JUN 22 1935 Hon. Zebulon Weaver, House of Representatives. My dear Mr. Weaver: In accordance with your oral request, I am enclosing herewith a copy of the memorandum opinion prepared for me by the Solicitor of this Department on June 11 concerning the Shenandoah-Great Smoky Mountains Parkway. The opinion raises a fundamental question concerning the authority of the Department to build this parkway under the National Industrial Recovery Aet of June 16, 1933, as extended by Executive order of June 7, made pursuant to the aet of April 8, 1935 (Public Resolution No. 11, 74th Congress)• This question is now pending before the Attorney General. Because of the very fundamental nature of this question further administrative action on this project is being delayed until the Attorney General's opinion has been rendered. Zebulon Weaver (1872-1948) was a lawyer and U.S. Representative from western North Carolina. He was a member of the North Carolina Park Commission and was involved in the land acquisition process that went towards establishment of the Great Smoky Mountain National Park and development of the Blue Ridge Parkway. This correspondence between Ickes and Weaver also includes a memorandum from Nathan Margold. Harold L. Ickes to Zebulon Weaver, June 22, 1935 In this letter Ickes, Secretary of the Interior, raises doubts regarding the authority of the Department of Interior to construct the Parkway under the National Recovery Act of June 16, 1933. He also mentions that he was enclosing a memorandum prepared by the Solicitor Nathan Margold regarding the Parkway and that it was now up to the Attorney General to decide on the issue. Memorandum for the Secretary from Nathan Margold, June 11, 1935 In this memorandum Margold, Solicitor for the Department of Interior, discusses the possible ways the Government can take possession of land for the purposes of constructing portions of the Shenandoah-Great Smoky Mountains National Parkway in North Carolina and also operating- it in the context of various court decisions and the Recovery Act.
