The first instrument to be considered herein is e deed, bearing date,Ma7 24.l875,from the Fxeoutors of Jas.R.Love,to Joua· Phillips fof Fifty acres. This deed is regular in form,properl7 executed,exce~t as noted below,and of record in Haywood Counrt. Only three of the Executors mentioned in the preamble signed this instrument; but that defect was remedied by a eonsent judgment signed in the case of Henry et al ve Billiard et al. See pagee ;vA-7_ 41 to 45 of this abstract. · For copy of de ed see page ~of this abstract. 3. On Oct.30,1895,.Jonas Phillips and hie wtfe,Sarah Phillipa executed a deed to ~.P.
