Tract 2.9 - J. S. WOODY. The lands under oonsi deration nre wholly vri thin the bounds of State Grant Number 252, issued to John Gray Blount. As the title has been treated, by mesne conveyances, from t he date of the issue of said Grant oown through the time when the holdings thereun­der passed, by the Will of James B. Love to his Executors, the same will not be repeated herein but may be seen by refer1·ing to the an­alysis of title to the Sidney .Nelson tract, begin."'ling at the first page of this Abstract. There are ~«o deeds from the Love ;;xecutors to J. v. Woody as follows:- 1. Deed dated October 1, 1881, for 100 acres; signed by only two of the four Executors named in the preamble but we consider this an immster1.al defect in view of the passage of time and ,of the agree~ent and consent judgment in the case of Henry et al., vs Hill-iard et nl. (See page if/ of this Abstract) p1 J The deed is acknowledged. by the ,oath and examination of the subscribi ng wi tneas and ouly recorded in Haywood County, Book "S", page 134-5. One-half of the mineral . is reserved in this deed as well as in various other traots conveyed by the Love . Executors, but all of this out­standing mineral interest has been acquired by a recent deed from the Love heairs whioh appears at page /.r; ~{a of this Abstract. See page z,J o of this Abstract. 227 ( .. 2. Deed from the Love Executors, signed and acknowledged same as the deed mentioned in preceeding ~ara graph. OoTers fifty-six acres. Recorded in Haywood County, Book 3, page 3•. See page ~ ~ I of th1.s .Abstract, 3, By warranty deed oated Januar,y 1, 1920, J. v. Woody oonTeyed the two tracts herein, -with other lands (appearing in title to Tract 235-a), to his wife, Laura Woody. The deed is properly executed, aokno~led~d and recorded in Bo ~ k 54, page 457. See page k; "'V"'of this Abstract. 4. Appearing herein is a judgment in the case of J.V.Woody ; ve Laura \Yoody, finding that the deed above mentioned wae obtained by fraud and undue influence and ordering the BBllle cancelled of re­cord and the tttle vested in J. v. Woody as though the deed had never been executed. See page :z..:.) 1= of this Abe traot. 5. No divorce was granted by the above decree (althoutn we understand the Court told Woody he wns entitled to it if he wanted it) but, under date of August 15, 1921, J. v. Woody "widower" oon- Teyed the lands herein to J. Sherman Woody. Incorporated in this deed are numerous stipulations and provisions,some of wh1 ch seem im­possible of performance, pertaining to the upkeep and improvement of the property; the care, maintenance etc., of the grantor, the transfer and reservation of certain personal pro perty described tn the deed etc, This deed is properly executed by Woody himself but 228 he is not joined by hie wife who was then (&nd is now) living and not divorced., see page J, v. Wodd7 ie now dead, 1~ o'f this Abstract).
