The V1ill is verJ brief and decidedly vagu~ as to description but was properly probated, never oon-tested nnd, apparently the description \"'laS clear to all of the heirs as there has never been any controversy or dispute among them as to the own• ership or possession of the lands devised the"'<mnder• For Will see page .;Jf-z of this Abstract • The remaining portion of Traot 224 was oonveyed by .Tames R.Love, personally and himself and others as E.,'"'{ecutors of R. LOve. deceased, to George Palmer. The deed is dated August 7, 1858 and calls for 210 aoree, more or less. It is not sisned by all of the parties whose narres appear in the preamble but this defect is, Ul'ldoubtedly, cured by the :passage ot time and by the Ag:t'ee~nt and consent Judgment in the case of Henry et al., vs. Hillie.m et al., by which al.l deeds previously exeeuted for the Love Speculation lande Wat:e l,"atified and confirmed. Palmer; it is made up or four separate parcels of land, all of which are wholly within state Grant Number 252 issued to John Gray Blount. As the title to the lands held under said Grant, 'from the date of its issue down through the time when they passed, by the Will ot: J emes R. Love to his Executors has been analyzed 1n detail in the Sidney N.elson title, the same will not be repeated herein but my be seen by referenc'9 to the title to the Sidrey Nelson Tract, pages one and following, beginning with paragraph one and ending with p:.tragraph ten. 73); I 1. The first deed for consideration herein is one fran R. D. Gilmer, Trustee and Administrator de bonis non to J. H.; Palmer; dated April 10, 1894 conveying seventy-nine acres of land.. The deed is signed by Gilmer personally instead of in his official capacity and is aeknov;ledged by the oath and examination of the subscribing witness. This defect, we think, is immaterial in view of the recognized authority or R.D.Gil:mer to execute such conveyances and as the l a nd has been in undisputed possession under this parent deed, since the date of same. For the authority of R. D.Giln:er to "execute titles" see Analysis of Title to the Sidney Nelson Txact hereinabove referred to. half of the mineral interest is reserved. A suit was filed in the Superior Court of Haywood County for partition of the lands of J • H. Palmer, all pleadings, orders, decrees J27 etc., in connection therewith have been copied in full in the title to Tract 240 and will not; therefore, be recited herein but may be seen by referring to pagee 1J. '!.. . and following of this Abstract. I By decree of the Court. ., in this proceeding, Lot Number 51 containing 4li Acres was set aside or allotted to M. c. Leatherwood (Mallek · 28,1896) (Special Proceedings Book 2 1 p8.ge 355, Haywoo:l County s uperior Court). 3. w. H. Leatherwood and M. c. Leatherwood, his wife, by Warranty Deed in regular form, properly executed, a cknowledged and reoorded 1 conveyed the 41-~ acres above mentioned - Lot No. 5 - to G. L. Palmer, reserving one-half of the mineral interest to the Love est ate • The deed is dated May 8, 1883, it is in proper form but it acknowledged by the oath and examination of the subscribing witness and is signed by only two of the four Executors named in the preamble. If this excep tion is located as shown on the map s of the :r:rorth Carolina Par}:: Co:mrlis ::;ion, 1m my opinion there is a suff icient record tit le . However, there is some uncertainty as to t he loc ation of this exception. There is some evidence t hat the exception is loca ted so as to ext end wes tward and cover a portion of the Duke Hannah Tract. If it is loc ated in th i s way, it would leave a s nall portion of the s outhern -part of thi s 50-acre tract as ahmm on the North Carolina Fark Commis sion's ma ps vested in the ::>uncrast Lumber Company.
