Caldwell, and is a :·' portion ot State Grant No. 252 1as.ued to John O,..ay Blount. As the Qhain of title tc:> state Grant No, 252 by l!1esne oonveyaneye.s from John Gray Blount t9 J, R. Love and Robert Love have been treated in the an~rsia of ,title to the tl"act o:r land owned by Sidney Nelson, being th$·Western portion of Traot No. 226• the same will not be repeated her•, but may be seen by re:terenoe to paragraphs . 1 through.., _1_o _ Q,t the analyst• ()f title of the abov~ referred to tract .• page 3 ot this abstract. 2. By ·re:fer(Jnoe to the analysis of title to the Sidnay NelEJon traot• it Will be seen that Robert Love and :r •. n. Love were veqted with title to state Grant No. 252 as joint tenants. see page ~f'Yf. said analysis. Therent'ter; Robert Love diod1 after first :pub- 11$hing hiEJ laS't will and test~nt - however, he failed to dispose ef the Speoulat;lon Lands by ea~d will. He t>.ppo1nted a.s his executors. ;r. R. Love, Dillard Lo'V'e, John B. I..o-ve and William Welch. lh On August 17• 18581 J. Rw Love, Dillard love• John B. Love and W1ll1a.m Welch, executors of Robert LQve, -deceased,_ oonvey~4 to Levi B. Caldwell a tract of land containing 150 ao~es 1 which bound ... a:ry emb:raoes all thE) land now unO.e:r tnvestisation. However, this deed is onl-y- s1gn$d by .r. :R._ Love 1 1nd~v1dU$lly, and ;r., n~ Love, executor. We are or the o;p1nion that 1 t is 1nu:nate:r1e.l whether or not the remainder or tbe e•o.utors signed• as Robert Love fa11EJ4 to dispose Qf the speou ... lat1on Lands by his will, and therero:re, his executors had no authority 94 , or power to convey the said land; and as R. J. Love in t he beginning owned one-halt of State Grant No. 262 in his own right and by virtue ot an agl;'etement en-tered into betwe.m the said ;r. R. Love and t he heir• at law of Robert Love, deceased, (see page ..M._ot t hie abstract} he became the owner of fourteen twenty-fou~hs Of all the Speculation Landa, State Grant No. 252 inclusive, and by the aforementioned agreement, the said ;. R. Love he.ld t he legal title t() t he remainder or th~ Spepula• tion Lands,as t:r!l1$tee, with full power and authority to make deeds to . . ... -··-····---- - ·-~ . any portion of said Specula:tion Lands. This agreement above mentioned was later ratified by a consent judgment in the oase of w. L. Henry, · administrator,. vs w. L. Hilliard, et al. See page.!!_of t his abstract. In this judgment, t he heirs at law of Robert Love, deoeased* and J. R. Love, deceased, rqtii'ied and conf irmed all sales of the specule.tion Lands ~de before the date of said judgment; therefore, we are or the opinion that even though the oo.nveyanoe to Levi Caldwell was irregular and not a good oonveya.noe in the beginning, any defect that might be found in said conveyance has been cured by t he agreement and judgment above referred tOo. This deed is of record in Haywood county. See page - ~~ of t.h is abstract. 4. Thereafter, Levi Caldwell died intestate leaving surviving him as his only heirs at law t he persons named in an affidaVit on page- 99 or t his abstract. 5. On April 251 18781. the heirs at law of Levi Cald.,.. well conveyed to Hi;ram J'. Caldwell the land under investigation. Thia deed does nat describe said l ands by metes and bounds, but locates JJaJDe by reference to creeks and adjoining land owners. This deed is duly recorded in Haywood County. See page 97 . of t his abstract, s. On September 101 1918, H. J. Caldwell and wife, Lizzie Caldwell, conveyed t he l and under investigation to R, E, Cald• well.
