As we :have treated State Grant :·ro. 252 from tho time said gr nnt was issued up through a nd including the time s aid gr ant passed by the last v;ill and testa­ment of .Tames R. Love to his executors, t he same will not be re­peated in t his analysis, but may be seen by reference to t he analysis of t1 tle of t he Sidney nelson tract, beginning 1:<i t h paragraph one, · of said analysis, and ending l':i th 11aragraph ton, page t hree of this abst r o.ct. 2. rrhe first instrument t hat \70 rlill consider affect-ing tract no. 212-a is a deed from Ja.'lles H. Love, D. Love, J. B. Love and Y: illiam \'Jelch, executors of Robert Lova, to Jes se n. t·'- lmer. This deed conveys to .res so H. Palmer a tro.ct of l o.nd containing 150 acres, which tract er1bro.cos tract No. 212-a. At t he date or t he execution of t his deed, J. n. ! ,ov0 owned a one-half lmdi vi fled interest in State Gr ant No.252, and t ho ot her one-half u.ndiviil.ed i nterest belonged to t he heirs of Robert Love~~ We have ex~unined t he will of llobert J"ove, and find that his executors v:ere not authorized to make conveyances of real estate. However, we are of the opinion t hat this deed, th01 gh defective at the date of its exec ution, conveys title to Jesse R. ra1• mer, as some time later in the case o:f \;. I. rrenry versus r •• 1 .• Hil• liard, by a consent judgmc~nt, all conveyances heretof ore made by J. R. Love or his executors , v1ere ratified and conf irmed by said -1- 362 judc;ment. This suit ;ms been fully treated in t he analysis of title of t he Sidney Nelson tract. See page 3 of t his abstract. The above deed is duly recort'ted in Haywood County. See 1mge :;GG of t his abstract. 3. Thereafter, sometime prior t o t he year 1896 1 Jesse R. Palmer died intestate. On ;January 25, l G96, ~.: . A. Palmer, widow of Jesse H. l 'almer, and his children, executed a deed to D. L. Caldwell conveying to said Caldwell a tract of l and containing 50 acres, v;hich tract iD a portion of t he 150 acre t r act ded ied to Jesse n. J>alJner by t he Love executors. This tr9.ct embraces tract No. 212-a. we have ol,tained an a f fidavit to t he effect t hat t he parties execut­ing this deed were t he only heirs at la-rr of Jesse n. Palmer. See page ?.70 of t his abstract. ?ne above deed i s duly recorded in Ray-wood Count·y·. see page 362 of t his abstract. 4. sometime prior to the year 1913, D. I .• Caldwell died int ostate without t)aving disposed of t!:1e l and :mentioned in the precedine pa r a -:;r apll of t his analysis. On J'Jovembcr 1?, 1913, Jesse Caldwell, one o:r "the heirs at lan of D. 1 .• Gnl dwell, conveyed a. one­fifth undivide-d. interest in three t r acts of l ond to · • J\ .• Palmer. Caldwell and his wife , Sar ah Co l d~ell a t their death, un ll 1'homas Culdwell a nd wife, Ella CaldYlell, );';ston Caldwell, l ~ardy Cr1 l dwell, v;. A. Pa l r.1er, r;uardian, and • A. :Pa l mer, individually, were made pHrty defendants. In said petition t he pl aintiffs ask that the -2- 363 l and t herein described be divided or sold. It appears that all rmr-t ies mccessary to t his suit \llere served •.'.1 th sur:nnons, and all party defendants join in a joint answer. l'he Clerk of the ~ :up erior Court, after considering the petition and answer, adjudeod that the l and be sold, and appointed John r.r. :~;uG en as comrnissioner to advertise the land according to law and sell s&-ne to the h i ~hest bidder. 'l'his proceeding ap ,.ears to be resular in every re­spect rd·th the oxco:Jtion that s old proceeding ·was not approved by s. judr;c of the superior Court. r ~ oTievcr, since a number of years have elapsed since the minors mentioned in said proceeding 'llU"i'C reached their major! ty, we arc of the opinion that thio d0feot has b e~n '.:tlred by a lapse of time. Uiorgo.n, trustee, a deed in trust conveying to sa id trustee three tracts of l Dnd. The second traot mentioned in said deed of trust being the land under investi gation. 'l'his deed of trust is given to secure t he amount or ... :6,000.00, and contains a power of sale authorizing the trustee to sell t he said 364 lands and convey to the purchaser a title in fee, should default be made in the payment or said indebtedness. Vle find from the records, that on July 15, .1922, '.~ . A. !Jnlmer and wife conveyed to n. L. Caldwell's heirs a tract of land said to contain one-fourth of an acre for the purpose of e. fa.-rnily crave­yard, which description embraces a portion of tract No. 212-a, Ho~1ever, t his deed v1as not filed for record until s eptember 7, 1922, while the deed in trust on '/. ~ A. Palmer and wife to .T. F. ::'orrsun, trustee, was - <1 .. filed for record September 21 1922. In said deed or trust the por­tion deeded for a graveyard is not excepted. Therefore, we are ot the opinion that title to the graveyard vested in the purchasers at t he trustee's sale when the aforementioned deed or trust was fore- 365 closed. However, since the purchasers at the trustee's sale ·were heirs of D. L. Caldwell, they were no doubt aware of the existence of the deod for tho graveyard lot. It would perhaps be the safest to obtain a quit claim deed to the gr aveyard lot from all the heirs of n. 1. Caldwell. Judgment recorded in Book_ ___ ..fi __ ___ P age _ _ lll ____ _ PROCEEDINGS ORDER OF SALE • This cause coming on to be heard before the undersigned Clerk of the Superior Court of Haywood County, and being heard upon the petition filed by the plaintiffs, and the answer filed by the defendant in the above entitled action, and it ap~aring to the Court, by the returns of the Coroner of Haywood County, on the back of t he summons issued in this c ause, that personal service was properly made upon all the defendants in this oause, and, it further appearing to the Court by the answer filed in this cause that the defendants admit the facts set forth in the petition and pray the Court for the relief demanded in said petition, and the Court further finding as a fact that all the defendants in this action have been a.u.ly served according to law, and all now in Court, and the Court further finding as a fact that it has been more than wenty days since the completion of the service of the summons upon the defendants. It is therefore ordered, adjudged and decreed by the Court that a sale of said lands, as described in the petition in this cause, be at public auction in the town of Waynesville, N. c., between tpe hours of twelve o'clock mid-day and one o'clock P.M., on Monday the 2nd day of February, 1914, to the highest bidder for cash, the lands herein ordered to be sold is fully described in the petition filed in this cause whioh is referred to for full description. It is further ordered that John M. Queen, be end he is hereby appointed a Commissioner of the Court to make said sale of the said lands. It is further ordered that the said John M.
