Cataloochee tract 204: W. M. Sutton heirs

  • This 48.5-acre tract 204 in Cataloochee was owned by the heirs of W. M. Sutton. While, in general, the Great Smoky Mountains region was sparsely populated, the Cataloochee Valley remained an exception. By 1900, the population of Cataloochee had grown to 1,000 residents living in hundreds of log and frame homes. A few historic buildings have been preserved on site, including two churches, a school, several homes, and outbuildings. The North Carolina Park Commission was tasked with purchasing land for the Great Smoky Mountains National Park and people living in Cataloochee were among those displaced. Cataloochee families continue to return for annual reunions. In 2001, the National Park Service re-introduced elk into the valley.

The first conveytmce of record a t'fecting this tract, as :omch, is a deed from A. ;r. Murray, Sheriff; showing that the land was sold by him in the ca se of G. L. Palmer vs. Y • .r,. Bennett. (No record fotmd of the Proceeding referred to) This deed is dated October 15, 1880 2Il.d oonveys 50 acres to Elizabeth Boyd. It is re-corded in Book ttV" , at page 350, recorda of Haywood County. Under date of n ovember 1, 1901, Elizabeth Doyd made a deed to W .J .G.B.Boyd calling for a m.nnber of tracts, the tract under consideration herein being the 47th Tract in the deed. The deed does not state whether Elizabeth Boyd was married or single (she was, in f act a widow}; it is qui te irregular in that all of the covenants as to seizin and \varranty appear to _ be made by W .;r .G.B.Boyd and the habendum clause is in f avor of Elizabeth Boyd. The deed is of re-cord in Book 19, p r-.ge 4?4, records of deeds of Hayw·ood County. See p og e of this t bstract. 3. VJ.,J.G.B.Boyd died, intestate, and proceedings were brought by various heirs for a settlement of his estate. The plaintiff's and defendants being all of the heirs, and the land hereinaft er described, which the Commissioner baa sold to the s aid Vl .M.Sutton is a part of the estate o f the said w.J.G.B.Boyd, deceased; and, VJHERE.AS, on the 22nd day of May, 1920, the Commissioner filed a report in the Superior Court of Haywood County, in the above entitled action, stating that he had sold the land hereinafter describ­ed to W .M.Sutton for the sura of :~~ 500.00; and the Commissioner consider• ed the bid a fair, adequate and reasonable one and recomrnends that the said sale be confirmed and the said bid not ha ving been raised, after having been filed in the Court for more than twenty days; and, WHEREAS , the affid avits of D.
